H-1Bs Encountering Problems at Airports 01/14/10

We have recently heard of accounts from H-1B workers entering from the Newark and Seattle airports encountering additional questioning, and in some cases expedited removal, by the Customs and Border Protection (CBP) officers. It seems most of the cases are occuring out of the Newark aiport and are primarily aimed at Indian H-1B workers employed by IT consulting firms. CBP officers are not only subjecting such workers to a litany of questions (one worker reported being questioned for over an hour) but the CBP officers are also voicing their opinions regarding the issuance of the initial H-1B. One officer is reported to have said that it was not legitimate for an IT consulting firm to be making a profit by billing the client for the services of an H-1B employee; another officer claimed that the H-1B petitioner should have been the client, not the IT consulting company. Further, another officer made the comment that H-1B workers was receiving salaries higher than Americans or taking away jobs from Americans. CBP questioning is so leading and coercive that the H-1B worker has no choice but to agree with the CBP officers. Obviously this line of questioning goes against many of the basic tenets of the immigration regulations. We are working hard to put an end to this type of “rogue” behavior by some CBP officers. Situation is getting worse for foreign health care workers. I'm trying to convince myself that maybe my fate is to stay or some other countries instead of U.S.

Still hoping that time will come that U.S. will be ready for us again. By then, make sure that all you need to do is carry your suitcases and leave.

I sincerely wish some one in this administration wakes up to these arbitrary handling of immigration matters and resolve the issues for LEGAL immigrants who are hard working tax paying residents. America needs these qualified people to get out of the pit they have dug themselves in with reckless spending. While its true OBAMA took over a mess – lets pray to GOD he does not add to it !!!!

hi can anybody answer my question?i have an on going immigrant petition , i just delivered my baby. my priority date is oct 2006.how can i petiton my child as well? so that i can bring him along with me during my embassy interview.what are the steps to do?

I just have an opinion about this retrogression. Please dont believe in any sign of good news that other people are spreading so as that they will be able to make a killing out of it. Please warned your relatives, friends and even yourself. if you are thinking that you will invest your precious financial resources(if you are rich then go on you can waste your money on these processes that are meaningless to say the least) into filing for Nclex, Ielts(except if it is intended for other countries like New Zealand, Australia or Canada) Visa screen or for I-140 petitions to the United States please think twice before doing those. You might end up losing your faith to the these system that are suppose to be fair.

They say ignorant is a bliss but this ignorance is really hell!

Just ask questions from these people here that experience these nightmares, but again it your choice to remain ignorant!

Hi,
I am on H1 B and working for India's top IT company..as an IT consultant at client site. . No additional layer but working at client site. I along with my wife and kid..have booked my India vacation ticket for 29-Jan and return via EWR airport,.on 26-Feb. With so many EWR/JFK issues for Indian H1 B IT worker. I am planning to carry my W2s, Pay stubs, etc, and also letter from employer stating the reason for visit as personal. Could there be any POE problems ? What do u suggest ?
