The May Visa Bulletin has been released. As expected there is no positive movement. The Bulletin confirms that there will be no positive movement until the next fiscal year, which is the October 2009 Visa Bulletin.

Although the EB3 dates are Unavailable, I-140 petitions may still be filed by companies who wish to petition for Immigrant Workers. The only way for a Beneficiary to get his or her spot in the queue is to have an I-140 filed on their behalf.

With the continued retrogression, the international staffing and recruiting industry is disappearing. Nurse and other allied healthcare workers from around the world are crossing the United States off their list of desired countries. The one hope is that Congress, when presented with legislation to allow international recruiting to be part of the solution, acts on that opportunity.

EB2 – all Current, except India (15Feb04) and China (15Feb05)
EB3 – all Unavailable

Dear HLG Team,

H1B cab has not reached. Is HLG, AAIHR, AILA, Healthcare facilities etc. trying to convince the congress at least to make Nurses eligible to apply for H1B visas. Hope all will appreciate this is an easiest solution pending a legislation like 5924. The present law does not allow Nurses to apply for H1B, except for special categories, since the qualification needed to practice as a Nurse in USA does not require a Bachelors degree. If such a change is made this will be a win win situation for both USA and the Healthcare Facilities/Nurses.

The cut-off dates for the Employment Third and Third preference “Other Worker” categories were held and then retrogressed in an effort to bring demand within the average monthly usage targets and the overall annual numerical limits. Despite these efforts, the amount of demand received from Citizenship and Immigration Services Offices for adjustment of status cases with priority dates that were significantly earlier than the established cut-off dates remained extremely high. As a result, these annual limits have been reached and both categories have become “Unavailable.”

Any hope for legislation (similar to HR5924) to get green cards for nurses this year? I have finished BSN since Dec06. I cannot practice due to lack of visa/GC. I see so many openings for nurses in my city but none for me.

I know you are our source for “insider information”. Any accurate information would be greatly appreciated.

My family was petitioned by one of LA (CA)s prestigious hospitals PD Oct 11, 2005. With 3 dependents, we have paid up $1,140 since July of 2006 aside from numerous related expenses incurred equivalent to a fortune. With VISA availability ON and OFF, we witnessed several excitements and depressions with the rainbow appearing behind the dark clouds, about to be within our reached, suddenly disappearing…and these happened several times. We kept on wondering whether this dream supported by our endeavor can still witness the dawn of the promised days, the glory of America with our involvement in its building a strong nation.

We continued to be quite and remain positive for years despite the odds, but we recognized that unless we speak out, these voices shall remain unheard in the vast wilderness.

To your EXCELLENCY & honorable officers…we have FAITH enough to understand your goodness and sincerity unquestioned beyond doubt of being of service not only to the Americans but to all citizens around the world. We appeal for your SWIFT RESOLVE on the immgration issue as follow:
1. An immediate relief act on those petitions that have been approved and NVC case completed but have been left dormant in the pipelines uncertain of what will be the future. This is the cry of many not only my family but all that suffers from this.
2. Create an immigration system adept with latest IT technology that rejects applications before it is received in the USCIS when the demand parallel to the available VISA QUOTA is no longer within the forecasted limits. This will provide the right discipline and guidelines for petitioners when to observe the GREEN and RED light. Existing H1B CAP could be a good example of such a pattern. This will also give a true picture and a clear guideline of those "competent and qualified soon to be beneficiaries" to have a definitive plan in accordance to a realistic scenario.

WE ARE SMALL VOICES WISHING TO BE HEARD AND TO BE WITH YOUR PEOPLE VERY SOON. WE DO NOT SEE WHY WE HAVE TO WAIT THE ECONOMIC CRISIS TO BE OVER IN ORDER TO BE THERE…WE WANTED TO BE A PART OF THE SOLUTION, NO MATTER HOW SMALL WE ARE…FOR THE FAMILY OF NURSES, WE CAN BETTER HELP AMERICA WHEN WE ARE INSIDE RATHER THAN JUST BE A WITNESS CROSSING OUR FINGERS DESPERATELY IN A HELPLESS SITUATION.

Pres. Obama to Announce Immigration Plans – 04-09-2009

Today, April 08, 2009, seems to be quite the active day with regard to immigration news. Not only was the May 2009 Visa Bulletin released on this day, but the New York Times published an excellent article announcing President Obama’s plans to spark the immigration debate within the coming months. This announcement does not come as such as a surprise though. After all, there was plenty of speculation, including some made by me, that the immigration debate would start soon (you can read my thoughts in previous posts: Immigration Highlights – 04-03-2009 and Follow Up to Immigration Highlights – 04-03-2009). Below is a relevant excerpt from today’s New York Times article:

While acknowledging that the recession makes the political battle more difficult, President Obama plans to begin addressing the country’s immigration system this year, including looking for a path for illegal immigrants to become legal, a senior administration official said on Wednesday. . . .

Mr. Obama plans to speak publicly about the issue in May, administration officials said, and over the summer he will convene working groups, including lawmakers from both parties and a range of immigration groups, to begin discussing possible legislation for as early as this fall.

Some White House officials said that immigration would not take precedence over the health care and energy proposals that Mr. Obama has identified as priorities. But the timetable is consistent with pledges Mr. Obama made to Hispanic groups in last year’s campaign.

He said then that comprehensive immigration legislation, including a plan to make legal status possible for an estimated 12 million illegal immigrants, would be a priority in his first year in office. Latino voters turned out strongly for Mr. Obama in the election.

“He intends to start the debate this year,” Ms. Muñoz said.

But with the economy seriously ailing, advocates on different sides of the debate said that immigration could become a polarizing issue for Mr. Obama in a year when he has many other major battles to fight.

Opponents, mainly Republicans, say they will seek to mobilize popular outrage against any effort to legalize unauthorized immigrant workers while so many Americans are out of jobs. . . .

Someone said before in order for us to be heard is to keep quiet. To keep quiet is to ignore or boycott the NCLEX collectively . As part of the solution we should warn others who would also be victims of retrogression to apply from other countries or else they will also suffer the same fate. It may sound negative to others but in reality we must also warn them of the rough road they will be traveling. There are so many applicants still waiting whose pd’s are year 2005. Then back again to 2003′s. This is pain to others..it’s really frustrating… Recruitment agencies should stop recruiting nurses or they too will suffer. So let us be quiet for a year or so.. Let’s unite and keep quiet for a moment.. Be quiet in Australia , New Zealand, UK. UAE,Saudi Arabia, Netherland, Singapore, or in your home country; serve your country..

Dear HLG I am an RN from CA I happened to visit your site very recently it is very intresting and good you are doing a wonderful job to help foreign trained RN’s to come to US.
In California their is RN shortage but no one is bothered especially the politicians.The shortage is felt very badly in Nursing homes LVN are plenty one or two RN’s are their to cover them and to supervise.Patient care can be found only in Dictionery Nursing Homes have become industries RN’s are scared to work in in Nursing Homes because of patient ratio.

To help the current situation in US nursing homes keep the continous flow of Foreign trained nurses through less controvercial legislations like issuing 25000 to 50000 visas every year which will not have much apposition from Nursing unions,Hispanic cacus and anti immigrants.

The proposed “Nursing Relief Act of 2009” would make it much faster and easier to bring trained nurses from Asian countries.

According to the Department of Labor, the current national nursing shortage exceeds 126,000.

Legislation to allow more nurses into the USA that needs more jobs for its own is probably impossible.

Pinoy nurses are not the priority of the USA now. Educating more nurses in the hope that they can migrate to the USA is sheer wishful thinking.

Pinoy parents, stop sending your students to nursing school. You are only making the nurse oversupply in the Philippines worse.

No amount of pleading can make the USA roll out the red carpet especially for Pinoy RNs.

So wake up, the “nursing demand/shortage” of the USA is OVER. Recruiting firms are shutting down as Hammond blog says.

To all new Pinoy RNs: the chance of you ever getting to the USA in the next 10 years or more is hopeless and bleak, even if the US economy recovers. Start looking for jobs in other countries.

“Do not be boastful, for you do not know if the visas will ever come.”

So many are doing AOS in the USA that those on CP in the Philippines have no chance of getting a visa anymore. The AOS folk in the USA are getting all the visas. Just watch the July 2007 PDs where over 800,000 applied for AOS. It would take 20 years for these people to be issued visas. Many nurses would already be dead before they ever get the coveted visa.

It’s over. Forget your American dreams.

The October 2009 VB WILL BE HOPELESS. It will be the same thing, the visas will disappear in barely 6 months because the people in the USA doing AOS will grab all the visas from those on Consular Processing anyway. There will be nothing good for those waiting on CP in the Philippines. Why not just abolish the CP. It’s torturing the those who wait in the Philippines.

Thanks GOD!!!…At last my agency is allowing me to apply for abroad now while waiting for my PD to become current (Aug 2006). I am checking now all the possibilities where to apply? They say, Qatar is offering good salary for ICU nurses. Is there anybody here that can help me where to apply? I do not know what my future will be if I keep waiting my PD to happen. I waited long enough already and I incurred a lot of debts. So I have to do something. I will leave my American dreams for a while. Thanks for this blog..More Power!!

Hi everyone! I am a pinay nurse, currently D.C. with PD of Aug 2006, im planningto apply for working visa, unfortunately my current agency does not cater H1B visa, but they are willing to release me, provided i reimburse all the expenses that had been incured. luckily found a new agency willing to sponsor my H1B visa.

my worries are will i still be able to maintain my EB3 status incase my PD becomes current, during my application for H1B.

Yes Tim, you can maintain your PD for EB3 as H1B is a dual intent visa. Can you please tell me which agency is doing H1B?

to SIMA- based from years 2007 to 2008, once visa becomes available again, priority dates further retrogress but lets pray harder this will not happen. The situation is very depressing but we cannot do anything about this.all we have to do is pray and find some other alternatives
