MMM released and update 04/14/08

HLG’s April MMM was published this weekend. The MMM can be emailed directly to your email account.

In other news, several Senators have co-sponsored a wide-ranging immigration bill that includes, among other things, a recapture provision for 61,000 Schedule A visas. This is the same provision that was pushed by HLG and the CTIHS last fall and unanimously passed by the Senate.

Because of our expected continued support, HLG and the CTIHS this year have focused on the House of Representatives. We shortly expect to announce some progress with the House, but we are still finalizing some details.

3 Bipartisan Bills to be introduced in the House by Congresswoman Lofgren of California.

3 Bills Brief Summary:
1. Exempting masters degrees and above in STEM from the limits.
2. Getting rid of country caps.(the removal of discriminatory practice of “per-country ceilings”).
3.Recapture of unused green cards.

None of these 3 bills are likely to have H1B cap changes in them. That may be the first time an immigration bill tied to high-skills employment-based immigration is devoid of H1B cap raise.
Immigration Voice and advocates and lobbyists are closely working with the office of Congresswoman Lofgren and other members of the House of Representatives on these three bills.

please clarify whether the immigration bill already introduced to recapture Schedule A visa has any chance to succeed or we should wait for another bill ? Do you mean the “progress” with the house which you expect to announce shortly is more significant than these bills ?

i just called NVC again and was told that my IV fee bill was generated on April 7, 2008 and will be sent to my lawyer in the next coming weeks. since my PD is already current, i am anxiously waiting if i could be scheduled for the interview next month in SG embassy the fact that my visa fee bill is just being settled.

when was your IV fee bill generated and when was it paid?

Anyone with good idea

Does following note in recent visa buletine of May 2008 indicate 90%of available visas for all category in 2008 fiscal year is already consumed by USCIS and Consular office and only around 10% will be left for the remaing 4-5
months.

E. EMPLOYMENT VISA AVAILABILITY

Many of the Employment cut-off dates have continued to advance more rapidly than might ordinarily be expected. This is a result of consultations with U.S. Citizenship and Immigration Services (USCIS) regarding their pending demand, which is currently using approximately 90% of all Employment numbers. USCIS has indicated that they would prefer to review a substantial number of cases at this time to ensure that number use in the various categories can be maximized. Should USCIS projections of the resulting number use prove to be incorrect it may be necessary to adjust the cut-off dates during the final quarter of FY-2008.

It says there that USCIS pending demand numbers to approx 90% of EB numbers. It does not mean that the 90% is already consumed or used. The USCIS projected demand is 90%. In the last part, it says there that the cut-off dates will be
adavanced if USCIS will not meet or accomplish its projected demand of 90% of the total visas. That means the 90% is not yet consumed or used.

It is impossible for USCIS to have used 90% of all EB visas already. They have no capability to process that huge number and one clear proof is the huge backlog of cases that we all know.

Need not read twice to understand what HLGs posted.

Have you seen th text of S.2839?
It includes provisions which will face hurdles at congress to pass. and Even if the bill come out of S.J.C. the Hispanic Caucus won’t allow such bill to pass freely without amnesty bill.

Will there be a Schedule A Bill alone??

Or else see another circus at congress and say BRAVO!!

My IV fee bill was paid by my agency last year when my Pd becomes current, at the same time with updated DS230, don’t worry you will only wait for a few days or weeks, since your PD is current probably you will receive your packet 4 in weeks time…..

Please check CGFNS for the other English requirements but IELTS is not part of it. TOEFL-iBT is, there is a different score requirement for PTs.

Please have your FCCPT certificate and when you have one, and you need help, I will give your name to my contact person.

As per Manila US Embassy website:

“All case processing for Manila, including appointment scheduling, is generally done at the National Visa Center (NVC) in the U.S. An applicant’s case number does not determine his or her position in the scheduling queue. Once a case is current, the applicant’s place in the scheduling queue will be determined by the date all the necessary, completed documents are received at NVC. Then the case becomes “documentarily qualified.”

My PD is Nov 2005. My visa is a derivative visa of an E3 petition. I am waiting for instructions on when to submit our DS230. Its possible it would be on the day of our interview.

HOUSE OF REPRESENTATIVES PASSES RELIGIOUS WORKER EXTENSION BILL

The US House passed by voice vote HR 5570, a bill which extends the green card program for special immigrant religious workers in religious occupations and vocations. The program was set to expire on October 1st of this year. The extension is until October 1st, 2010. However, the program will extend until 2016 if DHS issues anti-fraud regulations before the 2010 sunset date. DHS is also required to issue a report to Congress containing the results of a study on the effectiveness of the anti-fraud regulations and on a random audit of non-minister religious worker cases to see if such workers are still employed by the religious organization that petitioned for them or, if not, the reasons for their departure from the job. The bill must now pass in the Senate and be signed by the President before it becomes law.

I agree with the comment by lostherarter.The bill may not get passed in the senete as long as,it contains other amendments.When there is Schedule A alone Bill ,then there will be fare chance for it to be accepted by the senete.As am Being a nurse from INDIA,what i can do is just keep praying for that….

I think HLG is clear on this.

Schedule A bill will be cleared by senate. But it faces hurdles in House. HLG and allied groups are working with House to soften their stand and possible passage at House. Still the efforts are not sucessfull. So they have nothing to post at this time.

Let us pray for Schedule A bill..

Also the trend in the VB is clear.. ..

my pd is sept 2005 and i recently called up nvc and they informed me that they are currently awaiting receipt of my ds230 forms again before they could resume processing my case. i submitted my ds230 forms also last year prior to the july visa fiasco. i think this goes the same with you.

Yes I am done with NCLEX. Some applicants also are not NCLEX passer but was able to have a visa,
The letter from your petitioner must state that you will take NCLEX in USA and which hospital you are working.

Its very easy to check your interview date.Go to the US embassy website where you are being processed and you will find instructions on how to check for interview dates. You have to know your Case number.

Hi guys,

Hope this will answer your questions.

I am only a derivative of my wife’s sched A visa.We are Following to Join derivatives.Me and our 3 kids could have gotten a visa if we went with my wife on her embassy interview last Sept 2005 buy we did not and retrogression sidelined us. We are listed on her I-140 and DS230 as following to join.

our PD is the same as my wife pD on her petition: Nov 2005.

From the start, the embassy has told us that we will only submit our documents including the DS230 on the day of the interview itself. I did not believe them for a second but I guess I was wrong.

I dont know if my wife’s employment was direct hire or thru an agency but her petition was handled by an immigration law firm.

Dont worry guys. Your scheduled interview dates will come. The PDs will not backtrack till September. There is a lot of time. Just make sure to submit ASAP what NVC is asking again.

I read your posts on India. Being an Indian, I hope I can definitley comment on it.

You talk about the past of India, except for the professional workers. Things which happened thousands and thousands of year before. How does it matter to you or me at present.

I believe the present India is one of the worst country in the world. I dont find even a single thing which I can be proud about, in the present India.

Majority of Indians are just plain hypocrites. They are the least trustworthy people in the world. They are the one of the most fearful people in the world, without proper backbone.

India is number one in corruption. All the levels of administration is currupted to the core. Politicians are worse and corrupt in every way.

If you really want to see real racism, then come to India. All over India people are fighting and killing on the basis of colour, language, race, regions and religion. You wont find this much regionalism and factionalism in any part of India. There are only few places in the world you will see religious fanatics and murderers like in India.

Regarding the engineers and doctors and nurses. In India not even 10 percent of total admissions take place on the basis of merit and academics. Rest of seats are filled on the basis of money in your pocket. If you have money you can be an doctor or engineer or anybody. Its open sale of admissions in almost all proffessional colleges on the basis of money.

Do you want me to tell more about nursing colleges and quality of nursing education in our country especially in karnataka, tamilnadu, andra pradesh etc. Its better that I stop here.

I believe, every country is, what its people deserve. The country’s quality depends on the quality of its people. The people of every country gets what they deserve.

I am openly challenging you or anybody to prove what I said about India is wrong. What I said about our country is naked truth, the bitter present. Its foolishness to boast about India’s past, when you have worst present.

Its utter fanatism to boast about one’s country in a pulic forum like this.

Zoe Loftgren is the chair of the House Immigration Subcommittee. She is very bright and resourceful. My feeling is that she wouldn’t have introduced these bills unless she thought they had a good chance of passage.

and like to comment you on whatis reality now with Indians…and its true….sorry to tell this too…You said..Indians, are the least trustworthy people on earth…and its correct!!!!!!!!!!!!!!!becoz i rather work with chinese or Burmese with a handful of english rather than Indians…who are very calculative and cant be trusted…sorry to all Indians… but since Abilash u told us about the realities of Indians….i just make a comment on it and attest of what you said…

Hi anyone who has an idea about my case;

My PD is now current(Feb2006). I feel I’m misled. I have submitted a DS230 form for me and my daughter(I think it was quite sometime now) and paid our visa fees thru my agency(That was roughly 2 years ago). So, when can I expect to receive a letter from NVC that I’m documentarily qualified? What’s IV fee?when am I goin to pay for this and do I have to pay for my daughter too?

Plz. help me…

I work in one of the busiest floors in a hospital in downtown Maryland. Even agency Nurses who have been to several hospitals downtown will attest to this.
The regular staff is composed of Filipino, Indian, Black Americans, Nigerians, those from other parts of Africa, and a few Caucasian Americans. We may come from different races but we generally get along well.

It is sad to see in this forum that the retrogression has created a form of competition and envy. Lest you forget, a lot of those who post here are Nurses. Who knows, you may end up working in the same facility.

Rather than whine as to why one country is getting the upperhand focus on getting certified while waiting for your PD to get current.

There are no winners in the retrogression. Everyone loses.

The hohum posts about the greatness of one country is all hot air because it is off-topic and does not even amount to anything related to this thread. I believe your country has a yahoo group. IMHO posts like that are more appropriate there.

If the way your country is being run is so great then why leave and come here to the USA? If you’re really proud then dig deep and stay where you’re at.

When you get here, you will realize that in order for your unit to work well you will depend on your colleague and work as a team. Otherwise who will tend to your patients when you are on lunch break?

Nursing is about service and being able to impart TLC to your patient to the best of your abilities. Patients can be abusive and will work the call buttons. More so the patients who are Dilaudid seeking. You will soon learn that you will also have to deal with PCTs who will test you because you are the new fish on the floor. Save your energy. You will need it when you get here and have to deal with these realities.

My 2 cents worth.

As I am working in Kuwait, as Nurse. I know the quality of Nursing and other professional’s education of other countries. We Indian Nurses Completing a Nursing Diploma, after 10th we need to study 5 years more, If its a BSc Nursing 6 Years more. In other countries they complete BSc Nursing within 4 years after completing 10th, imagin the quality of education. In the case of NCLEX/RN, from My knowledge all most 90 percent of Indian nurses Passing NCLEX/RN in one sitting. That B,coz of our education quality. Of course there are some low quality college and schools…. But don’t blame all Institutions.

Mr. Abhilash can you tell the answer of this?
Why the Europe and America they only looking professionals from India. Why NASA is hiring more professionals from India. Why Microsoft.? Why Adobe?.Why IBM?. Why Intel…..?….

I never expect these comments from Mr.Abhilash.

Just have a few questions.
1. you mentioned you have a newborn, did you pay your newborn’s visa bill at the NVC or you will just pay it at the embassy during interview.

2. Was your newborns name included in the updated DS230 sent to NVC or you will just add her/his name at the embassy?

3. How long did it take you to process her NSO birth certificate?
I am asking because I am due to give birth end of April and my PD (NOv 2005) will be current on May 1. Since I will still not have her birth cert and passport by the time NVC will request for updated documents, I was wondering if there would be no problem when her name will just be added during the interview and visa bill paid at the Manila embassy instead of paying at the NVC which I think will cause another delay if I wait for her passport before updating our documents at the NVC.

4. Since you have an Oct 2005 PD which will be current on May 1. I was wondering if your lawyer have already received request from NVC to send updated documents? Did you send updated documents to your lawyer this month?

Hi Guys,

Finally the interview at the US embassy went well, I will have my Visa next week.

Here are the tips…

If you are working outside your home country, bring your employment contract to show that you are currently employed. as of me they asked for employment certificate but unfortunately I was not able to get one, luckily I bring my employment contract.

Bring all your License Certificate and your license card, If your card were expired just tell them that you don’t have it.

Make sure that you photocopy/xerox your originals.

You should know which hospital you are going to work and which state.

If you have a CGFNS cert. they will ask for it. If you don’t have its okey, Visa screen cert. will do.

They also ask when and where did you take your NCLEX Exam.

And some questions like, how long have you been working and which hospital. If you have children or if you are single. If you have relatives in the states.

hello mandy,

1. don’t worry about the visa bill of ur baby, once u have the interview shcd u will just pay direct to the embassy.

2. We signed new ds230 including our baby. During the interview will just present our DS230 to the consular. Ur agency also will advice to send a letter to the embassy stateting ur additional derivatives.

3. NSO processing it will take 1month after u gave birth… U should be the one follow up to the local civil registrar to make faster, just tell them that u will use this for passport abroad. The fee is only 125 pesos each copy. I suggest to request 6 copies.

There are two topics in this forum:
One is talking about how to go about thier embassy interviews and the other, argueing who is the better race. Obviously, those in the former have current PD’s and the latter are still in the dark.

Let’s just learn from this. No matter what race you are (Filipino,Indian, Chinese etc.)we are on the same boat. When we get to America we are but just immigrants.
I will probably look around and find out that the only person who will understand every nerve wrecking emotion that I have as an immigrant is the new Indian girl who arrived with me on that same floor. I cannot promise to hate her because this Indian(Senti) person pissed me off with his self serving comments on this forum.She might become my new best friend…who knows?
I am Filipino, I am very proud to be one. I too can enumerate some of the big shots in the Filipino World History. But I won’t. Other people’s achievements will not say anything about the kind of person I am. My own achievement should be more important. For now, like Senti, I am an underachiever, because my big American dream is not yet fulfilled. Which is why I made this comment.

To Senti:
Let’s get on. We have nothing else to do. We are bored waiting. We might as well argue.

When our PD becomes current, I promise I will be as friendly as the others and help you with all your embassy questions. And I hope you will help me with mine.

Kidding aside, I salute Abilash for being so brave to face the truth about his country. I know as much as you are disappointed, you too are as proud to be Indian as Senti. Like you, we Filipinos are going to America because the Philippines that we love so much is not apt to giving its best for her people. We will go forth so that we can come back and help our families. Indeed we are on the same boat.

This is not about who is the better race. (We all got hired, didn’t we). This is about who will get there first and come back soon.

Abilash, you clearly are better educated than them. You speak better English, your ideas are well thought of and If all Indians are as level headed as you, India will not be as bad. I for one, would rather work with you than these two.

In the end we are all children of God and we have only each other to turn to.

hi, can i ask if have license in the state of vermont or new mexico..do you really have to work there for at least a year or so? do the state of vermont and new mexico have those laws that prevent nurses from using thier state as an easy passage way to obtain a license and that is why they are requiring you to work in their state? can you explain further about the “reciprocity” issue. thanks and more power.

Can you tell me how many more months does an applicant must have to wait for his visa interview, from the time the NVC declared his application as documentarily qualified.

Good for those IV applicants whose consular post is in Manila for they can check their appointment schedule online but for us in middle east, there’s no such thing as online checking of appointment skeds. We really have to wait for the appointment letter then.

No one can tell you the time frame for the process. Different consulates have different time frames.
In the embassy here in the Philippines, they say its 3 to 5 months but there are a lot of cases that only takes a few weeks to couple of months.

Have you tried to check on the US embassy where your case is being processed?

My License is also from New Mexico.
All you have to do is apply for the reciprocity/endorsement for you to be able to practice in other state, for instance you want to practice in Florida, there is a form in which you have to fill up. No need for you to work in new Mexico.

You have a very valid point and I appreciate that. You talk about big companies like Microsoft, IBM, Accenture comming to India in search of talent. You are
talking about a shining and progressing Inida. Before I come to this let me clarfify my stand once and for all.

I you really read my comment, you would notice that I was talking about majority of Indians and not every body. More over I never told what ever you mentioned about India is not true.
I too agree what ever you told is true.

At the same time I also want to tell that what ever I told about India is also naked truth. India is slowly changing and thats because of confident Indians like Narayana Murthy, Aziz Premji, Tata, Ambani’s etc. These people believe in themselves and they are changing the buisness in the country.

And there is a great younger generation in India, who are confident, hard working and talented, who believe in themselves, who don’t care a shit about the hypocrisy and fanatism of older generation. With them lies the hope for India. And to get them big companies are coming to India.

But these are minority and they don’t even represent 10 percent of total population. Rest 90% of population hold accountable for every thing I commented. And I can still swear on that. Still I challenge any body to prove what ever I said is wrong. If you or anybody can prove me wrong on even a single thing I commented, I give you my word that I will never come back to this forum.

I live in the present. Neither I live in the past nor in the future. How does it matter to me if India was rich in pre historic times or it a cradle of ancient civilisation or had lot of
inventions in the stone age. I don’t either care if India becomes a super rich country in the future after 100 or 200 years, which I find difficult to believe seeing the present chaotic condition of India.

These are all politicians mesmerising sweet words to keep crowd sleeping, buffering and consoling their sufferings with false promises. Its is their
mask to keep then non accountable for their inability and corruption. I live in the present and I have clarity in my eyes to see the naked reality of India.

Do you know the growth rate of India plunged down from 9% to 6% this year, to the growth rate of 1998. Can’t you see the inflation and shooting up of price for everything every where. I don’t
believe in lying or false patriotism. I believe that for a change to happen, first we have to accept the truth as truth and then correct it. The empty words of patriotism and boasting is not my cup of tea. We should have the guts to shout at the roof top about the irregularites and injustices we see around and not to make most out of it.

India still account for its majority of wealth to Indians living abroad, like you. Can you imagine an India without their earnings, India will simply dissappear into ruins without
the wealth of Indians living abroad.

The most important thing is, if you or other Indians believe in Inda’s golden future, why do you all still want to go to America. Why don’t stay back here and participate in nation building. Why lakhs of Indians are still in US and other countries, pushing the priority dates behind and behind. Hope that tells you something.

The reason I posted my comment was because of your comment. Your comment is an indirect projection of the series of fight with Filipinos and other nationals in this forum, because of their advance of priority dates. They haven’t done anything illegal to get the jump in priority dates.

Its is the US law which ceil maximum 7% of annual quota to a single country. Without knowing the laws and facts of American immigration, many Indians in this forum quarells with Filipinos and other nationals, as if they have done something illegal. That is nothing but plain jealousy, selfishness and frustation. If anybody don’t feel happy about that, please be indifferent and atleast don’t insult them, since its their’s absolute legal right.

I am happy for them that they are getting the green cards, and I know one day my chance will come. I also wish to acknowledge that I have got enormous and critical help on immigration matters from Plilipino friends and other nationals, and I am sincerly thankful for that, and I do not like to stand people fighting on them unnecessarly.

And if anybody really feel per county limit is discriminatory, eventually each one of us will become a US citizen. Then go to your Senator or Representative and force them to change the law. And if you cannot wait that long, email or fax to the Senators or House representatives regarding your sufferings, or atleast participate in funding and campains of organisations like immigrationvoice.org, which fights against per country quota. But I can bet that no body will do these kind of proper and rightful things, instead of pouring jealousy and hatred on other nationals.

One more thing, you are absolutley wrong on the statistics on Indan nurses passing NCLEX on the first attempt. I invite your attention to the statistics published by NCLEX in their official website which details first timer’s and repeater’s passing rate for Indians and various other international candidates. Regarding the years of education of nurses, I can definitely tell you that none of the American nursing state boards accept nothing less than 12 + 3 years of education, for a foregin nurse. I am ignorant on level of education accepted in other countries.

I wish to end my side of comments on the matter, and I will not be taking this to any further. It was never my intention to hurt anybody’s feelings, and unfortunately if that happened, I ask for humble forgiveness. May God bless all of us.

congrats leen….just would like to ask ideas from both of you. do you think it is required during interview that you must be presently working as a nurse? I resigned work 2 years ago because I did not expect that retro would last this long. I took Nclex last year but i failed. Is it possible that I will be issued a visa even if I did not pass my nclex? My employer told me that I should take my nclex when I arrive in the US. They are now processing for my limited permit so that I can work valid for 1 year until I pass my nclex.My only concern is if I am entitled for a visa or it depends upon the consul?

Hi redflower,

If your employer told you that you have to take NCLEX in USA then be it,but they must indicate it in the letter that you have to bring during interview. As long as you have a visa screen cert and CGFNS cert, shouldn’t be a problem, I have a friend not also working for 3 years but the embassy issued her a visa, now she’s in Texas. Think positively….

I feel so responsible about all the chaos in this forum. I think it all started when I said something like ” Indians are ‘ignorant’ of the system”. It was harsh and uncalled for. I too would not want to be called ignorant. I should have just explained the little that I know of the system, rather than comment so harshly like that. I am SORRY.

To Senti: Truce. I am very sorry. I pushed you to publish what good that you know about your country and I respect your patriotism. I never meant for you to fight with each other. However different your opinion, it is valid & deserve due respect.

Filipinoes are friendly and very understanding people. I apologize to all my countrymen, you must be ashamed of what I have portrayed in this forum. It was only done because of boredom. All this waiting is really very unhealthy, it affects character & breeds contempt.

You are absolutely correct on your view points. I really hate to see stupid comments and crying in this forum. Sad to say, all is from our fellow Indians. Regarding your comments about the shining India, I totally agree. This agreement may be viewed by others as I am a pessimist and arrogant. But that is not the fact. I love my India and love to see she is progressing. But when I recollect my days over there in Kerala, New Delhi and else where during my search for admissions to higher institutions, I can say you did not exaggerated any points at all. All are correct. Those having merits are kicked out due to regional politics and money power. In my great nation I have had to sleep on floor, spent days with out food and all are just because of my ambitions to study on a merit basis. I tried to change the system, but eventually I realized the system is changing me. So my humble request to all from India reading and writing here in this bloggs is be proud of India as it is but not standing in the myth. Abhilash is correct, it is not the mistakes of Philippine, Europeans or any other countries that India is so back logged. It is just due to so many educated Indian ITs, which occupied most of the H1B visas are now want to get a green card. Whom the US government have to care. You, me, them? Please remember that US government does not have any obligations to you or me. It is all that whether you or me want to work in USA. Take home message is be a tolerant Indian. Do not quarrel or insult other nationals and don’t be jealous on others achievements. I do remember the use of this blogg space!!!!

3. In real estate companies from out side is investing in infastructure.
4. Country like japan is ready to invest billions os $ in india their delegation visited india in the last quater of last year
5. 14th may group of indian bussinessmen r going to usa for investments exchange.
6. There is a retail boom in the country because of which more jobs will be available
7. Healthcare industry is improving …. even there is shortage of nurses in india

Indian are appro 110 crore people. every one sixth of the humans living in the world is an Indian. Naturally India have progress and problems…every country has their own history , statistics, growth , problems..

Those who started the dispute here has gracefully retreated..and this is good example in this blog..

US immigrant law marks just less than 3000 GC for each country every year for EB3#. Indians also get the same number.The smallest country on earth can also get this number. These 3000 GC are shared by all EB#3 applicants from India according to their PD. These GC are already given to mostly computer fellow men whose PD are much earlier than nurses ie.2001 onwards. The PDs of rest of the world advances as these numbers are not yet utilised by applicants form that country.

Looking upon the trend last year DOS does not want to have any unused visas. They want to give 140000 green cards. If other countries cannot use these number,as per their quota, these GCs can be roll over to high chargability countries like India.

Therefore, Indians can hope that July visa bulletin for other countries will be current in July that they get the left over visas in additional to 3000 number.

Best wishes to all philippines nurses for your interviews!

In fact in 2007 , indians received more green cards than any other country.

Pray that the same will be repeated 2008!

this blog is for the updates of the Employment-based immigrating to the US. I cannot understand why you keep on stating each and every economic development or achievements of your country. No one is questioning you about that.

go to the Manila US Embassy website. Go to the Consular & Visa SErvices. then go to the Immigrant Visa Appointment. You will find their “click here and check for yopur case number”. click it and then enter your case number at the box indicated(very simple kasi there is only one box).

If you have already an appointment date, it will showyour medical exam date and the date of consular interview2

Since your files were at the consulate, there’s no need for you to fill up DS230, the embassy/consulate will give you the form during interview to update, or if there’s nothing to update, the consul will let you swear that everything you said is true,then after the interview you will sign the DS230.

To tell you the truth, I don’t know coz when my PD becomes current last year I was informed by my agency that I need to update my DS230 and never mention about doc. qualified, I just email NVC to follow up after 4 weeks and said that my papers has been forwarded at the embassy.

Hi, Noypi,
Yes, it is possible.Even if your file is pending and the VB happens to be current you can file for I-485 and EAD. (if you are in the US and in “legal” status).But if youre doing the CP route, you have to wait for your I-140 to be approved first, even if the VB is current.

Hi! I’m a religious reader of this blog and my pd is August 2006. 3 days ago i called up the NVC and the the automated machine answered “no visa available yet”. But now, i just called up NVC, the automated machine answered, “the lawyer will be receiving further information within 90 days”. Does this mean that NVC is already processing papers with PD August 2006? Thanks.

Hi Helen.

It is really of great probability that the processing of your case had also resumed or will resume in the coming months. Do keep in touch with your immigration lawyer every now and then for docmuments that needs to be submitted or updated with the NVC, note that your papers will only be forwarded to the local consulate when deemed as documentarily qualified.

Hi mixxer…First thing to do is to coordinate with your agency or immigration lawyer and ask for any updates regarding your case.NVC will definitley inform them with the progess of your application. Since your priority date is current, sure you’ll be scheduled for an interview soon when all the requirements required by the nvc are met. It is also essential to be assertive at times,as such, I suggest you to call/email the nvc to know your case status.

If possible get new NBI ASAP before your interview, it is one of the requirements, for sure the consular officer will not give you a visa, if you lack documents.

PD does not matter even if its current when one’s file is not complete and already at the US Embassy. There are plenty of cases that have earlier PDs than us but have no interview dates yet because their files are not yet documentarily qualified.Most are still at the NVC because some documents like the DS230 and the NBI clearance have expired dates.Updated documents have to be sent to NVC again for the file to be complete again and NVC will then schedule an interview date and forward the file to the Embassy. Contact your Agency/Employer ASAP about this.

NVC will not be able to schedule you for an interview date if you have not submitted an updated NBI clearance. Please read above response for tin2.

I believe a lot of cases who are current now have no interview dates yet because the DS230 I and II, 2×2 pics and the NBI clearance have expired. Contact your agency/lawyer/employer and ask them if you can send updated ones already EVEN IF they have not yet received a letter from NVC requesting for updated ones. So that they can send the documents immediately. Time is the essence here my friends and fellow bloggers.

bOLOG IS RIGHT. YOU HAVE TO SUBMIT THE FFNG: UPDATED DS 230 (take note there’s anew form which expires on 2010), NBI clearance, 2 pcs OF 2×2 PICS, PHOTOCOPY OF PASSPORT. IF YOU HAVE AN AGENCY SEND THESE DOCS TO THEM COZ THEY WILL FORWARD IT TO NVC AND ONLY THEN WILL NVC GIVE YOU A SCHEDULE IF ALL DOCS ARE COMPLETE

I just found out from other bloggers that NBI clearance need to submit at NVC, probably it is the new requirement, but as of me I never submit NBI or police cert. except during interview, if your files were now at the embassy then you can submit your NBI during interview, if it was still at NVC then you don’t have a choice but submit your NBI ASAP, so that they can proceed with the processing of your papers.

To Bolog or anyone,

Those with current PD’s with interview, which are in the Philippines, can I just ask if you receive an appointment letter from the embassy stating your interview date or you just found out at US embassy website…I am just curious.

SOrry I forgot to answer some of your questions.
You have checked from the embassy if you already have an interview date so I guess you know your case number.
Your file is at NVC so only NVC can inform and update you of your case status.You can call them (expensive but fast) or e-mail them (free but will take 2 weeks or more). I don’t recommend thru mail. I think that is obvious.

anyone can give me an answer, I called NVC this morning and the automatic voice said, they already sent out DS3032 to the beneficicary and to the petitioner together with the Affidavit of support. My question is, I am here in L.A. and still on status, if my PD will be current (Oct. 20, 2006)this coming VB we will be able to adjust?

Hi, Marvin,
If I were you, go for Consular Processing, coz AOS is so backlogged in issuing GCs. You will be issued a GC right away for CP. But if you opt for AOS, you can file for Permit (90 days waiting time) to be able to work for the employer. You can adjust as long as youre in legal status and can still use 245k (out of status w/in 180 days). Better consult an Atty as early as possible to get your papers ready if your opting for AOS, youre PD might be current this next VB. Goodluck!

i have not yet paid the visa fee bill.we have almost the same situation but im still not sure if il go for AOS because as what pnoyrn said it is faster to get the GC thru CP than AOS but what im worried is the VB in the future cos i know that it wont be long that VB will retrogress again that is why im contemplating to file for AOS. hope we can exchange note regarding our case.btw in what state are you in the US?

I am in the same situation as you guys, going for AOS, but lets look at the pros and cons:
AOS Route: (if VB Current)
Pros
1.Concurrent application of I-140/I-485/EAD/AP
2.If I-140 is still pending can still adjust.
3. Can use 245k if out of status (not more than 180 days).

GC approval takes years.
Cannot go home to visit the P.I. if you have used the 245k. You will possibly incur the 3-10 yr bar.So if the GC will take yrs to get approved, it also mean it will take yrs for you to be able to visit your home country.
CP Route:
Pros:
1. faster GC approval after interview the most is a month for the receipt of the actual GC.
Cons:
1. Bec of the unpredictability of the VB, as it quickly becomes Current it will also quickly change and retrogress in a couple of months, the hard part is that you are already interviewed at the US Embassy but suddenly kept in limbo bec of the Retro and sometimes the VB is unavailable.
So, the impt thing is we are in legal status, hopefully the VB will be current for the Phil.And for sure there will be significant changes in the Immigration laws concderning skilled professionals after the US Elections. Good Luck to all of us!

as a matter of fact, I’m already an NCLEX passer as well as a CG passer…so if I want to change hospitals, I can go to any state i want ‘coz i have the advantage of possessing a CG certificate!!!!

hi erwin_rn…you’re really correct that CG passers have the edge when it comes to changing states..although some of the states abolished the requirement of passing the CGFNS qualifiying exam and having the CG certificate, holders of CG certificates still hold the upperhand…

Hi..my PD is also on jul, but mine is 2006. if u have a lwayer or uou’re under an agency, it’s better if you contact them as early as now, coz you’ll never know that maybe the VB for June will also be forwarded, just like what happened for May…I was already contacted by my agency, and again I filled out DS230 form and submitted NSo certficates as well as NBI clearance…I know my case number ‘coz I called NVC and I found out that my visa fee bill has already been paid my my agency last Aug.30, 2007

Hi, cali_rn,
you say your papers just got filed last March, if your petition is still “pending”, and your on CP, you cannot be interviewed, you have to wait for your petition to be approved (the processing dates right now takes a year), but if your on AOS, when the visas become current, you can adjust status.

Well, 1st u absolutely need to know your PD..afterwards, it will be forwarded to USCIS for approval, which accrdng to pnoyrn takes almost a year now, in my case it was only 8 mos when my petition got approved…when it’s already approved, that will be forwarded to Nat’l Visa Center in New Hampshire..from then on, u just need to wait for your PD to bcome current, then you’ll be schedualed for med exam and interview…

i already contacted my attorney she from hammond law, and she said i should get ready the documents by now but she didnt advice me to send it until she ask. This was happened earlier..

All unused visa numbers remaining at the end of each fiscal year are wasted. That is, they expire without being used and cannot be used in subsequent fiscal years. The CIS Ombudsman, in his 2007 Annual Report to Congress, found that the INS/CIS had wasted more than 600,000 EB quota numbers since 1996 as a result of their inability to process enough AOS cases each year.

hi iaj,

If you know your case number you can inquire from NVC yourself on the status of your case. Call them. NVC’s number is posted on this thread.
If your case have already been completed last year, then it is most probably that what NVC will be requesting to update and complete your case will be updated passport copy, updated NBI clearance, recent 2×2 pics and updated DS230 I and II. But if they say that you should wait for the letter from NVC then there is nothing you can do but wait. It is only them who can submit the docs because they are the one who petitioned you.

My case is different from most of you since my petition has been in the embassy since Sept 2006. NVC does not process following to join petitions. It is the embassy who does this so I always followed up at the embassy.

CA state, in my own experience loads of my friends and future colleague did this AOS without any problem and they got their green card in less than a year. I-485 concurrent filing with EAD [? I-765].Once EAD result was released we can start working while waiting for GC, this is accdg to my lawyer Atty. Tancinco of SF.

Hi Guys…I contacted NVC weeks ago and presented them with questions which I believe you guys are also looking for answers. Hoping you’ll find this informative. Here it is:

1.) I have learned from my agent that Riyadh is my consular post. How long will it take for my papers to reach the Riyadh US embassy?

2.) If everything will run smooth, can u give me the approximate schedule of my interview and medical examination, upon my application becomes documentarily qualified?

ANSWERS:

Your inquiry has been received at the National Visa Center (NVC).

All correspondence concerning your petition has been sent to you in care of your attorney of record. You should contact your attorney concerning the present status of your case. If you no longer wish to utilize this attorney as your representative, please contact the NVC in writing. The NVC does not have an overall processing time due to the fact that we cannot estimate how long it would take someone to accurately complete and submit the requested documentation.

Once documentation is received at the NVC, the processing time for all documents to be reviewed is 2 to 4 weeks. Further information will be sent after the review is completed.

When an interview has been scheduled for the applicant, the NVC will send further instructions regarding the medical exam as well as the visa interview.

My advise is for you to start the application for NCLEX now. If you are already eligible, its already easy for you to decide where to sit for the exam. Since your PD is about to become current, it would be great if you’ll take the nclex here if you still have time so when youll be in US na, worry-free na you.

This lack of news from HLG is so disheartening. Their postings are so lacklustre this year just MMMs and visa bulletin news or stale news from other blogs, almost nothing on Schedule A. I hope they will update us soon and if really nothing is happening about Sch A, atleast inform us so that we can stop hanging on like this.

I’m not that familiar with the petition process, any help would be much appreciated.

-My case was filed to USCIS on February 2008. I saw the current Nebraska SC processing times and based on my estimation, it would take about a year before my case will be approved by the USCIS. Is it really that long? I also got confused if nurses are categorized as SCHEDULE A or SKILLED/PROFESSIONALS?

-What if the next VB will become current (C), will it be also a good news for those who still have pending/not yet approved case to USCIS?

As you know a NCLEX test center was established in the Phils. a bit year more than 1 year ago.Now that this test center is up and running there is really no barrier to having all applicants take the NCLEX exam prior to their arrival in the US.
In fact the NCLEX test center in thr Phillipines is a huge blessing to all nurses going to America. By writing and passing the Nclex exam before departing for the US, you are fully assured of being able to work as a RN at full RN salary almost immediately upon your arrival in the US.
In the past when nurses arrived in the US without having passed the Nclex exam and then they failed on their first attempt, they often found themselves in a very difficult situation, as failing the exam also cancels the temporary RN permit . The significant risk can now be eliminated by writing the Nclex exam in the Phils.
At the end of the day, all international RN’s must write and pass the Nclex exam.

most of the agencies requested all nurses to write and pass nclex before going to US as per employer’s demand because of the test center here in the Phils. So I think even if PD’s will be current, there is still no chance that visa number will be allocated for us because agency will not send our docs to NVC in order for us to be documentarily qualified not unless we pass nclex. So i think the best thing thing for us to do is to review and pass the nclex the 1st time.We cannot do anything about it because they are the ones who petitioned us. We will just wait if they will continue to submit our docs even if we dont have nclex.I’m just hoping they will do so because visa screen certificate is what the embassy requires. The important thing to note is that nobody knows when retro hits again, if that happes then we will wait for another years. Sana lang this agents will continue to send our updated papers to NVC even if we dont have nclex.

Even if your file was considered completed last year, remember that the NBI clearance you submitted then has a validity of only one year. Your pictures are only good for 6 months and the DS230 form you used has an expiration date also. Any one of these that gets expired will make your file incomplete again. That is why NVC will request for docs that are updated for your file to be considered complete again.

Processing will not take 68 weeks. It is 6 to 8 weeks.

Just be patient. I am confident that VB will not retrogress until August. There is nothing you can really do but wait for your agency’s instructions.

The decision to take the NCLEX is up to you. There are those that say that NCLEX is not a requirement for a visa to be issued. I am one of those who believe so since I know of others who were given visas even if they have not yet passed NCLEX and only took it when they were already in the US. But there are also others who say NCLEX is a requirement. Right now I am completely unsure. Browse the internet and visit other immigration forums and ask questions. Ask friends and relatives about their opinions. ASk yourself what you really want and if you really want to have it and finally pray for guidance from the Lord. I know choosing if you take it or not will either way completely turn your life upside down.

Question:Do you ahve to pass all your original requirements to NVC i.e. police clearances,birth certificate,as i am being asked to pass the originals with the DS230 so that my case will move forward.Please reply.Thanks

You have to pass your original docs to NVC. For the police clearance from foreign countries (not the NBI) I suggest you have it photocopied (colored) and have it certified true copy by a lawyer so that when consul ask for a copy of it during the interview you can show one and just tell them that the original was passed to NVC.

You got me confused :) sorry i am doing night shift and my brain is not working well lusot be:) The reuqirements i need to pass is Ds230 form,police clearnaces form foreign countries,NBI,Birth certificate,passport-biographical page and photos right to my agent!Question is is all original if not which one should be and which should be photocopy.Thanks!

Everything should be original except the passport (xerox only). But if this is just updating of docs and not the first time to pass it you only have to pass updated DS230, orig NBI, photopy passport, 2×2 pics, orig police cert if applicable.

If you are being asked to send the originals then send the originals.Bubbly-phil is right that only the passport should be a photocopy that will be sent to NVC. The rest should be original copies.

hi bolog
my agent called me just this morning and asking me to prepare again photocopy of my passport, new nbi, submit pics. As of now, they are waiting for another fee bill because there was a change of visa fee from $380 to $400 now. Then maybe daw I should fill up again another DS230, so i have to prepare again. It will really take a lot of months before my case will be documentarily qualified. I should stop inquiring on the visa appointments dates not unless I will be able to submit again new sets of the required docs.So tiring.

Hi Redflower.

I believe your on your way to your USA dream. But of course, going to US is never that easy. Plenty of things to be done, not to mention the submission of documents u’ve stated. Really TIME is our sole enemy at this time. We need to rush up things and be able to submit the required docs to the nvc otherwise, appointment for medical and interview will take more months from now.

According to NVC, once complete docs is received, it will take about 2-4 weeks for them to review your case. Once declared documentarily qualified, they will forawrd your papers to the local consulate. Medical and interview schedule then will depend on the workload of the consular post, which will take another 1-2 more months.

Hoping for the Best. Cheers to all those nurses with curent PDs.

Be patient and persevere. Ganyan talaga ang process. You have expired docs so you have to update them. Send them ASAP to your lawyer. PDs will not retrogress until July or August. I am optimistic on that. Kaya pa yan. Dont worry at aabot ka.

Regarding the visa fee bill. If you have already paid them last year, NVC will not ask you to pay again. Kung nagbayad ka ng $380 eh di ka na kasama sa $400 increased fee. Unless when you sent your $380, your lawyer did not pay this to NVC. For your info, I got this from the Manila US Embassy website:

“Effective January 1, 2008, the immigrant visa application fee will increase from U.S. $335 to U.S. $355 plus a U.S. $45 visa security enhancement surcharge. Therefore the total immigrant visa application fee is U.S. $400. For “K” and “V” non-immigrant visas, the application fee will increase from U.S. $100 to U.S. $131.
The increase in fees will be used to cover the cost of enhanced biometric security features which have been added to the visa application process.
Immigrant visa applicants who have already paid the U.S. $335 application fee before January 1, 2008, will not be charged an additional payment even if they are scheduled and appear for their interview after January 1, 2008. Applicants who will make their payment after January 1, 2008, will be required to pay the increase even if the original bill sent before January 1, 2008, indicates the U.S. $335 fee.”

Do clarify this with your lawyer.
