Why did the EB3 dates move forward? 02/22/08

As every reader of the HLG Healthcare Immigration Blog is surely aware, the EB3 Visa Bulletin dates just leapt forward, which is great news. Essentially the reason that the DOS did this is because the US fiscal year is nearly half over (the fiscal year runs Oct 1- September 30), and the DOS is concerned that all of the visas will not be used. It was this phenomenon – lack of using all visas – that caused the Visa Gate scandal of 2007. By moving the dates ahead now, instead of waiting for June or July like last year, the DOS hopes to avoid having to over-progress the dates this summer.

By way of background, there are two ways that visas can be claimed — (i) domestically via the I-485 Adjustment of Status and (ii) internationally via the DOS’ Consulate system. Ideally the US government wants the visas to be used on a priority date basis, which is to say that it shouldn’t matter if the I-140 is filed for an AOS or CP; the approval of the immigrant visa should be the same.

The USCIS, which is the agency that works the AOS cases, has likely indicated to the DOS that it cannot process as many cases as necessary. Therefore by moving the dates aggressively ahead, it is allowing the Consulates to use more of the visas (which is good for the PTs and RNs!).

Note however that Section D of the Visa Bulletin in Section D says that if the USCIS improves its processing of AOS cases, the DOS may re-retrogress the EB3 date. On the other hand if the USCIS continues to be unable to timely process AOS cases, there is a chance sometime this spring for the dates to continue to move forward.

None of this reduces or eliminates the need for legislation aimed at curing the retrogression of numbers for Schedule A workers. We’re still working on it. We’re making slow but steady progress. I’m optimistic that we can get something done this year, but it is slow-going. A move for EB3 all chargeable area is only reasonable, they were stuck since last june. new set of numbers were issued Oct 1,2007 and they are using them now for the first time, hopefully to use as much before the end of the fiscal year which is Sept 30,2008.
Other categories have been “C” for sometime now, so it is only fair to give others a chance.

The backlog has to be cleared and i hope the bulletin will progress up to At least sept 30,2007.remember they were at about july 2006 when they went back into rertogression last year, i was hoping they would pick up from where they left off.

im in a difficult situation right now coz my I94 will expire in the next 3 months and i dont see the eb3 ot be current..

gee..its really a difficult situation.

To all asking about endorsing to VT:

I tried to email and call CA bon a thousand times and they give me not a clear answer. I did write them a formal letter to extend my CA application and stated my reasons…. didn’t get an answer thru email but they sent out a mail after my application has expired.

With regard to VT. You can email them and they answer in about 2 days, just send them both the pass letter that looks like an ATT and the letter from CA bon that you have passed the NCLEX-Ca. They have nice website that you could see the date they recieved your application and payment and you can also email them on the status of your application, you can tell them that you already passed CA nclex.

As you know USA needs big number of nurses and your experience in your home country honed your skills to be effective nurses in the US. People are working in the foreign nurses’behalf. we never can tell the number of years you have to wait to avail visa, the basis for issuing visa depends on PD and we never know how long is the que before your PD becomes current. however, there is a big push ongoing to cure retrogression and if this happens you don’t have to wait many years. there is also movement in PD, jan.2005, and who knows if this will continue to move forward and and reach your PD before year ends…
right now, just relax and enjoy what you are in to. also, don’t forget to pray for i always believe that nothing is impossible with HIM…

Yes, I had my file extended for another year but since CA bon was not replying to my letters and emails months before the expiration, I decided to have my NCLEX transferred to VT to save my test scores…. I knew my file was extended when my VT license was out and when I didn’t expect it to happen… I guess CA bon won’t extend your file early if its not really near the expiration date. My opinion.

Not all with approved I-140 with PD before Jan. 1, 2005 will be guaranteed to be allocated a visa number.Only those that the NVC deemed as Documentarily Qualified cases or in simpler terms:cases that are already with complete documents are really sure to be given visas.
If ones I-140 is already approved then one should make sure to submit all required documents and pay all fees as fast as possible as instructed by the NVC. Time is very important considering the erratic movement of the Visa Bulletin. Ones PD may be current now but after a month it may not be and one month is not enough time for some to complete all necessary documents and payments. But I think the PD for next month will still advance up to Jan 2006.

To HLG,

Kindly clarify your statement that the PDs for EB3 may retrogress if their is a huge demand. What section D say is very much different because it did not say any retrogression. Section D of the March 2008 VB said “If the expected increase in CIS number use materializes, future cut-off date movements could slow or stop”.

So retrogression was not stated.It said that PDs movement could slow or stop but not retrogress to a later date than the present published PDs. Can we have a clarification.

Retrogression is the slowing down or stopping of visa numbers.

So when the DOS in Sec. D says: “If the expected increase in CIS number use materializes, future cut-off date movements could slow or stop.”

you can read it as “If the expected increase in CIS number use materializes, the dates will retrogress.”

I was told by my agency that my papers was now at the consulate, last year of June my PD become current and after a while retrogress again. I also email NVC and same thing, that was said by my agency.

thanks and well said.I wrote CA-BRN twice,emailed them again to remind them that my file/validity is just about to expire and indeed not a word from them.and now I just got tired of worrying,what for..my validity had already expired and I havent tried applying for this so called reciprocity.At any rate I hope that despite the silence,they did extend it anyway.

Hi Hun,

My PD was Feb 2007. Was approved in June 2007. Then got my invoice to pay the visa fee bill USD 380 per head and we to our agent. Till today my agent couldn’t able to pay the bill, as they say from last July onwards NVC is not accepting any payment.. I can’t understand how this can happen…

Can anybody give me a reply…

As long as the NVC sent you the IV fee bill,you have the option to pay it as soon as possible or later during the interview.Now,you can email them if they are really processing or not.dont rely much to your agency , do your own research and get first hand info from NVC itself thru email. They will reply you at least after 2 weeks or more..

I paid my NVC fee bills last August 2006 submitted and updated DS230 and other requirement twice..Im still waitng

Yes. I do contacted NVC. but their reply also gives us nothing but confusion. “visa no. not available etc.etc.”. My real doubt is that after the payment only we will be allowed to submit DS-230. Isn’t it? If it so, since last 8 months my DS-230 is lying with my agent! Atleast it would have been moved to Embossy. or atleast documently qualified for a visa(PCC,marriage & birth certificates..etc. etc)Then we would have been in the quota (if there is any issuance of visa. It’s really unfortunate!

As far as i know the NVC usually forward the DS 230 to the Embassy if your PD is about to become current..

I have not not tried calling up the NVC to know the status of my DS 230..I will just wait for the Visa Bulletin to move in the coming months.As long as i have paid the IV fee bill and NVC sent me DS 230 and letter to update it from time to time at least twice already (once last 2006 and latest 2007,i believed it was stucked up at NVC and it will forwarded anytime as soon as my PD become current..Only God knows when is the time, just keep on praying and enjoy what we have in our own country..Good luck!

“This was the one I received when I contacted NVC to enquire about the time when I can pay my fees”

Unfortunately, this case no longer has a visa number available. This is because the applicant’ visa category is oversubscribed, meaning that the available numerical limit of visas able to be issued was reached. Upon reaching the numerical limit of visas able to be issued, only beneficiaries who have a priority date earlier than listed in the current Visa Bulletin may be allotted a visa number in this visa category.

The priority date is the date when the petition was filed at a Department of Homeland Security (DHS) office or submitted to an Embassy or Consulate abroad. In employment immigration the priority date may be the date the labor certification application was received by the Department of Labor (DOL). You may call (202) 663-1541 or visit our website at http://travel.state.gov/visa/frvi_bulletin.html for priority dates currently being processed.

The beneficiary should NOT make any travel arrangements, sell property, or give up his/her employment until he/she has actually received a visa from the US Embassy or Consulate General. When this case becomes eligible to begin processing again, any unexpired fees previously submitted to the National Visa Center will be applied to the case. The National Visa Center will notify you when further action is required.

CA request for extension must be done in hard copy and not thru emails just to make sure they recieve your request. I send 3 request, one addressed to MS Lisa Chan, I got her name from a person who also had his file extended.

to all CA passers with near expiry: pls contact your agency or lawyer and ask them to request for an extension of your license they usually the one to request it.

Dear HLG

Do you have something to comment about the so called “closure of NVC”.

Forgive me if I am wrong. As per my knowledge:

1. If we are allowed to pay the fees, then DS-230 forms will be issued to us..
2. After submission of DS-230 forms, we will be asked to submit our supporting docs. such as birth, marriage certificates, PCCs etc..
3. After scruiteny it moves to embassy or they keep with them (whatever)
4. Whenever our PD becomes current, we will be called for an interview, and last but not the least
5. we will be granted a visa

If NVC is closed then it will take atleast 5-6 months for this process, if schedule A is passed or PDs become current. Most of our friends having almost similar PDs say that their payment as well as DS-230 were accepted..Do you have any personal contact in NVC to know about my file status..

This refers to the state of California BON

The ca bon sent me a letter by post and they stated they would be extending my file by one year (which will take me up to April 2009). after this time unless i provide an SSN they will destroy my file. however, as i wrote on here prev my agency have informed me that CA BON are aware of retrogression and they will keep on extending our files on a yearly basis if we request them to do so.

Hello Unsure,

Having a CGFNS certificate and visa screen certificate can qualify you to be issued a visa, please read greg siskind’s abc of nurse migration. Please review the contract you signed with your employer/agency because some of them require a foreign educated nurse to pass NCLEX RN before your departure to the U.S.

Please try passing the NCLEX RN asap to eliminate this concern.

Grace is correct.NCLEX is not required for issuance of visa. But what the Embassy will require is the job offer from the hospital/employer that will hire you and I dont think the hospital/employer will provide one if you have not complied with their NCLEX requirement.

Thats all depends on your travel agent,and employer. nurses can migrate to US without RN/NCLEX,.one of my friend she is in US now , she did visa proces from Qattar, and she traveled without RN/NCLEX. CGFNS. she passed RN/NCLEX from United states, Still she don’t have CGFNS certification. Agent they knows somany tricky ways. Better you complete all certification before……… After all depends on God’s blessings.

i agree with the people who said that you dont need the nclex to get a immigrant visa if you already have your cgfns cert, or visascreen but you still need to pass your NCLEX for you to work as a nurse in the US.so dont worry if you failed your NCLEX you will still get your visa.

to bolog,
even if you have not pass the nclex they will still issue job offer because they are the one who filed your petition in the first place.

I-140 and I-485
on OCT 2006,
and I-140 is already approved and
I am already here in USA working as RN with my EAD.
I would like to know when they will send us our Green Card???

Hi, because your PD is Oct. 2006, the present Visa Bulletin USCIS is Processing right now is Jan 2005, it means that you have to wait for the Visa Bulletin to move to Oct 2006 (your PD date), for you to be able to get or receive your Greencard. I hope this helps.

thanks so much for your info.i called up the us embassy here in the phils. and the call agent who answered me told me that Consuls ask visa applicants to present proof of passing the NCLEX during interviews.They will not issue the visa unless I present them a passing NCLEX result. I get more pressured now…

if you failed on ur NCLEX how would your petitioner continue the processing even if your PD will be current soon. You have to pass the NLCEX first before you will be given a visa. Try hard on your test.

yes i just the my ITIN no. on it but they still know if it is an ITIN or SSN ,anyway they will just issue you your license then they will send you a pocket with a certificate and a letter stating that you have to get a SSN to renew your license.i understand what you feel because i have the same concern with you before.

To fellow nurses planning to take NCLEX RN:

Please check the streaming video of Kaplan and read their book entitled “the basics.” It is alright if you won’t finish the book, the important thing is you scan the topics that are frequently asked in the NCLEX RN. Kaplan’s questions are patterned after NCLEX so it will provide you a good venue for practice. Please practice answering as many questions using “Saunder’s Comprehensive review for NCLEX RN, 3rd edition,” make sure that you understand the rationale of the corect answers. In my opinion, the most important book that you need to read cover to cover is “nclex rn strategies for the registered nursing licensing exam 2007/2008 edition” by Kaplan. It will show you tricks how to pass your nclex rn test.

With the limited time that you have to comply with nclex, these are the materials that I can recommend to you.

The thing is, most of my friends that have used Kaplan or have reviewed with Kaplan failed in the exam. But in fairness maybe it is their fault and not kaplan’s, but this is just a personal experience.

The problem with using techniques is that it will never tell you what is the real score or the concept behind a disease or a disease process or how a drug works for example captopril.

What I did is that I focused more on the concept, rather on the technique. Then I did self review for about 6 months with NCLEX 3000 that is the free disc that you will get if you will buy Brunner and suddart’s medsurg. Then I make sure that I have all the books that I need from funda to medsug to focus on Nursing Pharmacology by karch and I think, I have 18 books all in all including lab values and significane. Then I graduated with Saunders Q & A with an average of 82% with multiple categories exams. When I took NCLEX-RN, I went inside at around 0805 then got out at around 0849 and to be honest I was thinking at that time to go the Golden Gate bridge but not to do things that you may think but to reflect on what is my next move if I “failed”. The next day, I was in Amazon.com browsing for used nursing books since i have given away my books to friends in the P.I. who need books.
But I got the 1 page letter, so I think I made it very good when t comes to the logit. Your choice!

for me use NSNA reviewer it is more simple and easy to understand.most of my friends whouse nsna passed th nclex ,inluding yours truly.because for me understanding is the key,it is not how many books or how many references you are uusing…

If I am not mistaken,US embassy would only require VISASCREEN certificate and employment contract from the petitioner during interview for nurses under EB3 petition. For you to have a VS cert. you have to pass either CGFNS or NCLEX exam, plus English proficiency test. Embassy would not require you to pass NCLEX UNLESS it is stipulated in your employment contract that for you to be issued an immig. visa at any US embassy you must pass NCLEX. Some petitioner would specifiy this in your employment contract and your petitioner would of course inform you beforehand or at the very start of your I140 processing (contract that you will be bringing to the embassy during the interview)that passing an NCLEX before the embassy interview is a must, and the US embassy would honor this. This happened to one of my friend’s friend, wherein the embassy required passing NCLEX exam. But in reality only Visascreen and employment contract is needed, not the NCLEX. You can contest this if they will deny you. hope i am not confusing those who are confused.

Some of the Nurses was able to go to US either they passed NCLEX or CGFNS, as long as you have the Visa Screen Certificate, it was not stipulated in any interview that you should pass NCLEX first before they issue a visa, as long a you have a petitioner.

If one of you planning to take the NCLEX exam I reccommend that you only concentrate in one or two books, KAPLAN- all the questions are easy,not too difficult to answer, for me I used KAPLAN reviewer first then followed by SAUNDERS, all the Questions are too difficult and the CD contain important questions that you cannot find in other review materials, and of course you should know the strategy in answering multiple questions…. PRAY before you enter the examination room….GOODLUCK for those planning to take and retake the NCLEX Exam.

i think kaplan mirror the NCLEX exam in terms of priority questions. i study a lot for the exam, took an nclex review $400, did saunders Q&A,comprehensive sauders CD…did the kaplan book and kaplan trainer cd. kaplan trainer cd with 7 exam is priceless. you learn how to answer priority question. the way nclex ask question is the same way in kaplan. i had a lot of priority question in my exam, and kaplan helps a lot. saunders is more for content review. passed with 75 by the way. good luck sa inyo!

Can I apply for a working visa while waiting for an immigrant visa?
Is that a good move? or would a working visa discredit my immigrant petition?

the current PD that are being processed right now is Jan. 2005. so, at least you still be waiting for a year for yours to be current, hopefully the PDs wont retrogress. As of now there are no “working visas” for Nurses, Nurses are only petitioned for Greencards/ Permanent Residence. H1b visa is very remote for Nurses to be approved. If you are on Consular Processing theres no immediate way to go to the US to work, you have to wait in your home country to be processed and be able to work in the US.If youre in the US, you can go to the Adjustment of Status route to be able to work right away coz theres the concurrent filing of I-140 and I-1485, together with the Employment Authrization and Advance Parole.(only if youre PD is Current,theres no Retrogression and youre in legal status). i dnt any idea if you can get ITIN if your outside the US.after you get your license it a lifetime already you only have to renew it every 3yrs if im not mistaken,which means that even if you dont have SSN yet and you cannot renew your license you already a RN for life because your name is in their master list.

we have the same situation before,b4 my I94 expires i went back to phils so that i will not become out of status and im waiting also for the visa bulletin to be current or for the schedule A visa to be available and go back to the states to file an AOS coz it seems that its faster to have the immigrant visa if we go for AOS than CP,it would only take 6mos the most as long as visa is available.as my lawyer said we can only file AOS after 3mos of stay tyo avoid to be technical in our application

Everyday all i do is watch CSPAN and hope to see something about nursing shortage..etc.

What can we do to help HLG get the message across the Senate/Congress/President?

Its getting frustrating because they are talking about ILLEGAL IMMIGRATION but they have forgotten about us who are in line.. waiting.. doing things LEGALLY!

Good news for physicians, although I wonder if the bill will ever emerge from the committees, most bills perish there. If it does survive maybe it will be the perfect vehicle to attach Sch A amdt to.
These type of bills shifts the focus from immigration issues to issues regarding healthcare shortage and its victims. This will provide a reason to the legislators to vote for it. Since it only talks about healthcare, other controversial amdts regarding H-1Bs etc etc have no relevance here.
The CTIHS should lobby to attach our amdt to similar bills that are non-controversial and hence easier to pass.

tnx. my question is what if there’s a schedule a visa and were back home at P.I?if we leave for US then it would be useless, we cant apply for AOS because we need to stay for 3 months 1st.

i guess its all about timing and a lot of luck.

hopefully theyll include the sched a on this conrad bill.

To the one asking regarding if the embassy will issue visa if one has taken the nclex-rn and failed, I think the embassy will require to take it again because by attempting to take it but failing the test disqualifies one for interim permit application. You won’t be able to work as an rn without it.

True that the contract may only require cgfns but if you have attempted nclex-rn and failed, you must really take it again.

If you haven’t taken nclex-rn(attempted), the embassy would have given you a visa because you would have qualified for IP with cgfns cert and visa screen.

Nothing is more important to have a 100% focus for NCLEX exams. This was the tip given to us by R.A. Gapuz plus the techniques he provided in analyzing questions. I used these techniques for the last 30 questions of my exams when I took NCLEX in HK in 2006. As expected, they helped me a lot. My computer stopped at item 75. Try R.A. Gapuz Review Center Philippines and you won’t regret it. I am now completing my NVC requirements to have my interview scheduled since my priority date is June 2005..

i received my petition approval dated feb.2008.my priority date was july 2007.accdg. to the letter they sent it already to nvc and i should wait for 90 days for the processing of our visa.when will i received my ds-230 or is it the same with what they called as packet 3?help me pls.
