Within an hour of our last post, the DOS’ Visa Bulletin was released. As expected, some EB categories greatly moved forward; notably processing is now available for All Other Countries and the Philippines who filed prior to January 1, 2005.
EB1 – all current, as usual.
EB2 – all current, except China (Dec 1, 2003), and India (U).
EB3 – all countries (Jan 1, 2005), China (Dec 1, 2002), India (Aug 1, 2001), Mexico (May 1, 2001), Philippines (Jan 1, 2005).

D. EMPLOYMENT VISA AVAILABILITY
The cut-off date movement for March in several Employment categories has been greater than those experienced in recent months. Advancement of the cut-off dates at this time should prevent a situation later in the fiscal year where there are large amounts of numbers available but not enough time to use them. If the expected increase in CIS number use materializes, future cut-off date movements could slow or stop.

I can just imagine a lot of EB3 Philippine people smiling. Some of which are those very impatient people which I dont really blame for I understand how they feel. Good luck people and you are nearer to your American Dream.
For those whose PDs later than the current PD (myself included, Nov. 2005 EB3 Phil), lets just be patient and have faith in God. Our PDs will come.

If you are from philippines or from non retorgressed countries, you will get the visa. Hope this helps.
My(RN)chennai consulate interview was on 11th July’07.some PCCs was not available at the time of interview.and we submitted all the required PCCs by Sept’07.unfortunately due to retrogression still we have not received our visas.
pl tell me when i can get a date for my visa interview again?PCCs need to be revalidated??
So as to prevent visa fiascos/rush from happening again, I believe that there is a need to just put “dates”(like for the march 2008 VB it’s Jan 01, 2005) instead of “C” or current because usually, the ones who really take advantage of it are the AOS applicants, putting consular applicants at a disadvantage(funnel effect). However, with these dates being put, everything will be done in order…Of course, everyone would want a current visa for schedule a or eb-3 at that but until such time that congress/senate could make and unanimously agree on a bill that would allow visas to be current especially for schedule a, then I’d really suggest that visa bulletin for EB-3 be writtten with dates.
I think it’s about time that CP(consular processing) applicants be given due respect/equal representation, as I believe no CP applicant benefitted from the July visa fiasco, only AOS…
However, I am still hoping for a schedule a visa…May God bless us all…

But maybe bad news for the Indian nurses, if the Phillipine EB3 cut off continues to move at this rate then very soon retrogression will be relieved for them while it will exsist for the Indian nurses. But as Phillipines supplies majority of foreign nurses, there will be no more need for Schedule A or recapturing of visas. Wonder who will fight for retrogressed indian nurses? Furthermore recruiters may actually replace Indian nurses waiting in queue with Phillipine nurses as they can arrive much much sooner.
I hope HLG will really work actively to promote the Sch A bill in the present scenario.
I assume this event will move into a more comfortable zone for all of us nurses waiting for the “current” status in eb3s.. time will definitely come for the moment were all been waiting for.. let me hear some if not all this third quarter of the year..

I have learned not to trust the VB anymore. While this big movement seems encouraging, it is nothing but another stealing-from Peter-to give Paul-and Mary-trick. You use visas meant for Peter so Paul and Mary can move a little now, wait until it’s Paul and Mary’s turn to get bumped so Peter can move forward……..
Whoever calls the shots in this system should make up their mind and decide whether they truly need EB folks or not. I have friends who are still in queue who have abandoned the idea of waiting and have moved to another place. Only time can tell whether these folks made a good choice or not.

It was indeed a big development for the Philippines to have the priority date moved to January 1, 2005. I pray more good news are coming for all of us in the next months to come.
To all nurses,I congratulate everyone including me for being patient all through out.My pd is July 2006 and hope the april visa bulletin becomes current sa all of us will be accommodated.My cousin left for US last Sept with pd of July 2005 so to those with earlier pd than this, definitely you are the next on line.For us with later pd that Jan 2005, our time will come and hopefully this May or June of this year.
is Physical Therapy (Philippines) included in EB1 Or EB3? please help…

In view of the latest VB movement in EB3ROW and EB3Phil, kindly advise what effect it will have on Indian nurses also whether it will have any impact on the lobbying efforts and strategies of CTIHS?
The last quota of sch A visas cleared cases upt early 2006 PD, then could the EB3 Phil in next VB jump to Jan 2006?

here is some more another bad news for the nurses from the eastern countries
UK is also gonna close their job market 4 nurses due to massive immigaration
all the nurses wating for us dont waste ur time , wake up do some thing , it is the right time

one month its showing no change and another month three move, is it strange, but even then interesting, one day we all move to america, what u all say?
Now a days other countries too showing interest in catching nurses, like UAE, UK, Newzeland, Canada, Australia, denmark, y not move to these countries for a short while and come back as and when visa open, even then it will take 6-8 months for recently cleared nurses.

If you passed the NCLEX Dec. 2004 probably your priority date is January 2005, Ask your agency if you are under the agency….or you can email NVC and ask fo your priority date.
To all the nurses that are still waiting…our time will come. I just hope there will be more movement of the EB3 on the coming VB…my PD is May 2005…let’s just keep on praying.

Let us offer some short prayers for all the people hurt by the NIU shooting in Illinois. Hopefully, such incident won’t happen again in the US. We were in the US during the Virginia incident last year and it was a very sad incident.
Hopefully US will be a more peaceful place when we move there to work.

Although a current visa is greatly desired by many, it may not bode well especially for those who are applying by CP(consular processing) considering the present US laws that limit the number of visas that can be issued…Should the VB be made current at this present time where US laws limit the number of visas that can be issued for a particular country, the July 2007 visa fiasco will happen again(the “funnel effect”).
A Schedule A visa is still needed because there are lots of professions under the EB-3 hence, not all might be given a visa if everybody crowds in such category.
Many will be disappointed, frustrated, etc…
I think it is still best to put order/chronology, first come first served basis given the visa numerical limits per country under current US laws.
Yes, people no longer have confidence given the “one step forward, two steps backward” style of the visa bulletin plus the “stability” issue and the fickle-mindedness of their agency.
Let us just see what happens. If it’s your time, it’s your time.
I hope they’ll do it better this time having learned from what happened in July 2007. I hope they will be fair and exercise prudent justice at all times, as they claim that they “do things fairly”.

Why is it, that you are still damned if you speak very good english, and dont want to violate immigrations laws and a law abiding citizen. An American by heart and soul but not yet on paper, an ambtious and hardworking man that can greatly contribute to the welfare of this country.
Highly skilled individual who has a degree like myself,who is highly needed, who passed NCLEX-RN, Passed Ielts/Toefl, who has a visascreen, and did everything what he is being asked for but did not complain, but at the end day still hopeless, not accepted and discarded. Why worked very hard and waited for so many years and not be accepted as an immigrant and if not, even just a chance to work in this country and prove my worth? maybe this country is not great after all? Or maybe the people that have been entrusted to run this country are plain inutile and are not even worth mentioning? I still hope and pray and that My GOD that it is the latter rather than the former: what happen to my great country, United States of America?

Your situation is not bad at all actually, your priority date being current, it wil be much easier for you to find a new sponsor and update your existing file, thus keeping your Priority Date, just hurry up before you loose it all.

we are on the same situation before,i was in the U.S before the retro happen and i filed my papers before it happen and i waited for 6 mos thinking that i might get my I485 or the AOS but it did not materialize that is why i decided to go home before my I94 expire and wait our papers here in the phils.
my advice to you is to go home and for the VB to be current and go back because it would only take like 6mos to get your greencard when you go for AOS as long as the VB is current or there is a schedule A VISA

As far as I know, if you were able to file I140 together with I485, you can retain your priority even if your employer closed. Try to discuss your case with a good lawyer. By the way are you here in US?

Im a nurse from the Phils, have an approved I140 just waiting for my visa. Do you guys have any idea about H1B for nurses? Tried to ask some immigrant lawyers but they don’t have any idea about this. Some recruitment agencies from non profit hospitals in US are recruiting nurses for H1B? Are you aware of this?
H1b i think is a working visa. I heard of such also. Some employers are pirating nurses , who are waiting for retro to lift. The offer is a working visa with guaranteed 6 months processing. The catch is you must give a surety bond of a thousand dollors. This type of visa allows you to apply for immigrant status also and you can bring your family with you. My query is this, if one does grab this oppurtunity, what happens to the immigrant petition you have with your former employee? Does it mean you have to start from zero? Or will it mean waiver of such if you get a working visa instead? Can anyone shed light on this? thanks!

H1B is just a working visa for bachelors degree holder, It is valid for 6 years and you can bring your family wih you in a different kind of visa, but your family cannot work in the US.
I am also waiting for the retrogression to be lifted or my PD to be current, and my agency decided to apply for the H1B visa on my behalf while waiting…but it is only a 50-50 chance of giving you this visa…now once the retro is lifted or my PD become current the employer will re-apply for change of status, but your PD will not be affected at all…
it might be a good news for Filipino nurses..hopefully it would not be another “fiassssco” like what happend last November…anyway that’s a GOO0000OD news…
hi.H1B visa is a working visa,the processing of this type of visa is every april 1st but usually on the first day of filing the visa available is consumed because it is only very limited and in case that you will be approved you will be issued a H1B visa on october which is the start of fiscal year.
be careful of an agency that requires surety bond because most of the agency that hire nurses dont ask for processing fee or bond usually they are the one shouldering all the payments and fees
i research about the h1b for nurses. to be eligible you must be
A.have a master degree
B. possess a specialize skills
C. bachelors degree.
ive talk to a lawyer and he said that its a slim chance for a nurse unless if you 2 out of 3 of those qualification.
there a hospital that ive talk to theyre willing to sponsor h1b nurses as long as they dont pay for anything.

Here is tha solution.
Endorse your license to either NEW MEXICO or VERMONT BRN. There is a fee for this and it is not cheap since you will be paying CALIFORNIA BRN and the States BRN that you are endorsing to but you will not have to go the nightmares of going and taking the NCLEX EXAM again. The sleepless nights, the crying because the computer shuts down at 40 minutes, the embarassment that you have to endure should you fail next time.
***BUT ONCE YOU ENDORSE IT, IT BECOMES A PERMANENT LICENSE THAT YOU CAN HANG IN YOUR LIVING ROOM.***
Some people would tell you that can have ITIN even though you are in paete, Laguna enjoying lambanog because your license is about to expire and your pd is no where near North expressway. You know better than that. IRS does not issue ITIN to those individual outside the U.S. and although it is true that sometimes ITIN can be mistaken as an SSN by the CA BRN, because it has the same sequence but sometimes they can detect it.
****Beware**** to those wo are in the U.S in B1B2, if you have to get ITIN, just make sure you are covered, I heard a lot of stories of A to A because they got ITIN before they left and when they came back, they were A to A Because ITIN means that you to pay taxes or get tax rebates but you are not allowed to have SSN, Bingo!!!
Maybe after these ordeal, we are better nurses than before.
