Call to Action: Say No to the H-1B Fee Increase Amendment 10/31/07

The House and Senate appropriations committees are scheduled to meet this Thursday, November 1st to discuss the combination of the Defense, Military Construction-VA and the Labor-HHS-Education appropriations bills into a single bill. As part of these discussions, the committees will consider including or excluding the Grassley-Sanders amendment (H.ADMT.3396) which adds an additional $3500 fee to the already excessive H-1B visa fees. This additional $3500 is to be used towards the creation of a special education fund to promote studies in the fields of math, science, and engineering.

HLG joins the American Immigration Lawyers Association (AILA) in strongly opposing this fee increase. The addition of such a fee would make it even more difficult for US businesses to hire skilled foreign workers. According to CongressDaily, Democrats might send Bush about 70% of the total $955 billion in discretionary spending they seek for FY 2008 in one package that would include the Defense (HR 3222), Labor-HHS-Education (HR 3043) and Military Construction-Veterans Affairs (HR 2642) appropriations bills. The move would place Bush in the “position of vetoing the $670 billion package over $10 billion Democrats added for education, health and welfare programs,” CongressDaily reports. In addition, the move would place Republicans in a difficult position during a vote to override the veto, according to CongressDaily (Cohn, CongressDaily, 10/26). However, “Bush might come out on the winning end under this scenario if he is able to convince the public, and enough Republicans, that Democrats are holding troops’ and veterans’ funds hostage in exchange for pork,” CongressDaily reports (Cohn/Goode, CongressDaily, 10/29).

Democrats have scheduled formal negotiations to resolve differences in the House and Senate versions of the Defense and Labor-HHS-Education appropriations bills for Nov. 1, with floor votes expected as early as the week of Nov. 5. In the event that Democrats do not combine the discretionary spending in the three appropriations bills into one package, they likely will first send Bush the Labor-HHS-Education bill (Clarke, CQ Today, 10/26).

Bush has threatened to veto the bill because the legislation exceeds his request for discretionary spending by $22 billion. According to the Post, “Another continuing resolution looks likely, and some in both parties predict the spending saga will drag into January,” a move that would “increase the risk that, in the end, Democrats will have to merge unfinished bills into a single omnibus, whose hundreds of pages would blur their domestic agenda and hand Republicans a coup” (Washington Post, 10/27).

hey,
this is a little conspicuous here.

I always thought the privileged Visa for all of us was the EB-3 immigrant visa (aka Green Card).
the ones who usually take advantage of the H1-B are high-tech employees who find it easier to go through.
And I don’t particularly feel sorry for the High-Tech industry to have to pay those fees. As long as their employees are still under the H1-B visa, the under-pay them (my brother was able to maintain his salary while taking one extra day off a week since he got his green card)
So I am very much in favor of such a fee as it will promote development of that particular field.

if the actual HHS bill passes, that means 61.000 visas available for us and only for us ( Schedule A workers)
H1-B visas are anyway all taken mostly by High-Tech workers the first day applications are accepted.
Notice also that on EB-3 immigrant visas, the extra fee here described do not exist.

All together, the ones who really need these visas (H1-B) are the ones who have the extra money to pay for it and also this will develop the education system in the US.
Do not think only about your immediate future, but if you intend to immigrate to the US, think also about the long range.

This extra $3,500 is good for the economy

Dear Alan,
that’s the idea…
No country, not even the US wants to rely solely on immigration.
please note a few points:
- the fee is for the employer to pay ( not you)
- the fee is reasonable : think a high-tech worker earns around $60,000 or $70,000 as a start over 5 years, $3,500 is barely 1.16 % of the employee’s salary. (for companies employing over 25 people)
- the logic behind limitations in visa numbers is not to lower the salaries and whereas in theory the H1-B workers are supposed to have the same salary as the market in fact it doesn’t happen
- immigration is not the long term solution for a certain lack in particular professions
- education is

Excuse me please. I just think we should think of H1-B and schedule A together. The amendment reflects the USA’s attitude to immigrants. They are against immigrants now. The door is closing and all of us are outside the door.

We should not have narrow thinking: H1-B is not related to us. Do you think USA will treat you well when they treat H1-B holders like this only because you are a nurse?

Why should we pay their education fee? Only because we are doing the job which not enough Americans can do?

Anyway, it is not a big deal. like anonymous said, the bill will be vetoed next week.

Sorry, I disagree with Clement. Basically US immigration system is unfair. It is based on what origin country you come from (such as retrogression based on your birth country). The US immigration system alreay have too much unfairness. Remember the respect is gained by hard work and is not by someone’s mercy. Black people gained their voting right through fight. If you don’t fight this unfairness (for example bullying on H1B people), someday when you are bullied, no one else will stand up for you. For nurses, frankly speaking, we have too much advantages already. For example, we can at least possibly have the bridge bill that claims visa number that should be shared among all immigrants. So the bottom line is we, immigrants should unite together and fight together for what we deserve.

An other point that here shocks me is the reference to the Nazi era that you are making, you can’t possibly be willing to live in a country that you consider being “nazi style”.
I just hope this was just an innocent mistake due to lack of knowledge of the context your paraphrase was taken of…

disagreeing on opinions is one thing but referring to the US as a nazi country is a totally different one.

You may read Black people. Come on, that is an analogy. Also please read the visa bulletin. There is a catagory for each country. For example, people from China, India or Mexico, have different retrogression time that other country. Is that clear enough?

Criticizing is great and it appears that you don’t understand why the “current date” is different on a few countries, it is just because those countries already have a lot of their citizens immigrating to the US and the different dates are to prevent an overflow that would unbalance the general population.

H-1B has always been there…Clement is right…the $3,500 fee is for employer to pay not YOU…so if the employer hiring you will charge that fee to you then try think it over…

What is important is for the Schedule A relief…that is why retrogression has become a big issue…please dont use the Schedule A for your agenda(H-1b people)

For sure it will be sign by Pres. Bush because it will bring revenue to them…

Schudule A people be happy our amendment is a no cost amendment which means it will get attached whatever will happen to H-1b amendment…as long as nobody in the conference has the intention to remove it manually…

You could be wrong there, if there is a ruckus created over the Grassley amendment, then it may result in removal of all immigration related riders attched to the bill as the main bill itself is so controversial the last thing anyone needs is re-awakening of the immigration debate.

is the delay of this amendment. Think USA is a big country and the govt. have lots of important jobs to finish before this FY. And the implementation of this amendment is only important for us and not for them. And remember nobody is forcing anyone to serve them. So be quit and pray for the successful completion of the bill.

I’ll just qoute Sen Durbin speech…with this speech I do believe that the whole senate & house has realized the great shortage of nurses in the US

The bill will be vetoed down by the Prez. The question is will it be attached again in the new bill. Its a political battle between the Democrats and the Prez and none are gonna give in.

If you follow the SCHIP, this bill was vetoed by the Prez and it went back to the House and now its in the Senate. The Congress does not have 2/3 majority to over ride any veto. Any clubbed bill will also be vetoed. At present no one know what the new move will be by the Congress or the President. The President need the spending bills passed and the war spending money, while the Congress wants its bills passed. Lets see what happens…
Just dont be too positive. The years 2001-2009 are worst years for immigration. Starting 2009 immigration will be easier…

HR 3043 is passed by both congress and senate,only waiting for making some changes,to avoid possible veto and after that will be sent to president.It is up to President whether to veto or not.We can all pray to god to give blessings and not to be vetoed.Please do not be depressed.But if it is vetoed,no chance in 2008 also,hope only in 2009 after election.

House and Senate appropriators agreed on a spending package Thursday that includes funding for health, education and veterans’ programs, but not the Pentagon. Democrats are hoping to force Republicans to support more domestic funding than President Bush requested.

The conference agreement combines the $150.7 billion Labor-HHS-Education bill and the $64.7 billion Military Construction-VA measure.

Last night, House Appropriations Chairman David R. Obey , D-Wis., decided not to include the Defense spending bill as part of the package after Republicans objected strongly to its inclusion. He said he wanted to show Democrats are “serious about compromise.”

A House vote on the two-bill combination is likely on Tuesday or Wednesday next week. The Senate would vote soon after.

President Bush is expected to veto the measure. He has repeatedly objected to the funding levels in the health, education and labor measure — although he has indicated he would sign the veterans’ bill if it was sent to him separately.

Currently the entire federal government is operating under a stopgap spending measure that expires Nov. 16.

Frustrated by Bush’s refusal to accept more domestic spending than he initially requested, the Democratic Congress has not sent the president a single one of the 12 appropriations bills for the fiscal year that began Oct. 1.

“11/02/2007: H.R. 3043 Conference Made a Small Partial Success for the Level II Hurdle Without Complete Success

As we reported earlier, the strategy of Democrats is to combine three spending bills in a packet so that the President cannot veto the Labor-HHS spending bill which the immigrant community has a stake in. First bill is Defense spending bill. Second bill is Military Construction and Veterans spending bill. The third bill is Labor-HHS spending bill. Report indicates that yesterday the Democrat conferees dropped the Defense spending bill from the packet strategy as a gesture to the Republican conferees to accomocate their stance opposing the packet concept. The Defense bill constitutes a large portion in the federal spending. However, there still remains a confrontation between the Democrats and the Republicans as the Republicans continue to insist that the Labor-HHS spending bill be handled as a stand-alone bill. The Republican strategy is to pass and send the stand-alone Labor-HHS spending bill to the President who promised to veto the bill. The problem for the Democrats appears to be the President’s continuing threat to veto the spending bills inasmuch as the current Labor-HHS spending is presented to him either in a packet or a stand-alone bill.

The immigration riders have yet to survive at the Level I, which is for the conferees to drop the H-1B Supplemental Fee bill and to agree to the EB-3 visa number recapture bill. The outcome of the Conference compromise can turn the immigrant stakeholders into a serious predicament and split, to wit, what the immigrant community should do if the Conference adopts both bills. From the H-1B community perspectives, they are better off to lobby for the President’s veto of the entire H.R. 3043 so that the H-1B Supplemental Fee legislation goes to the tomb. On the other hand, the allied healthcare worker supporters and lobbists may still want the H.R. 3043 signed by the President. So far, there is no indication that the immigrant community and stakeholders have found any common ground of strategy to deal with such potential crisis. Since the H-1B Supplemental Fee bill is such a huge disaster for the U.S. employers in the high-end industry and academic/research community, potential conflict between this sector and medical sector in the immigrant community is indeed a nightmare. The Conference Committee is expected to complete the work before the end of next week. Please stay tuned.”

NURSE, H-1B FEES TORPEDOED FROM BUDGET BILL

I have learned that the immigration provisions that would have created 61,000 additional green cards for nurses as well as added a $3500 fee to H-1B visas have not survived the conference committee and will not be a part of the bill sent to the President (which he is set to veto). There is much speculation as to why this happened. Many people were deeply troubled by the H-1B and its impact on non-profit and smaller employers. In order to allow Senator Grassley to save face, the push was made to strip all immigration provisions out, even though the H-1B fee opponents likely supported the nurses. We also understand the California Nurses Association, the most vocal anti-immigration nursing group in the country, worked behind the scenes to try and kill the nursing provision. Nice that they care so much about their patients and would rather push death rates up rather than immediately dealing with the nursing crisis.

Be sure that nothing will move again atleast untill Febuary, there is no need to pray and stuff… this is the reality, The thing I dont get is how come the amendment passed unanimus in the Senate and got canceled in the conference so fast, without even a struggle by the Senators, also Sen Hutchison is part of the conference it was supposed to work to our advantage.

I am with real tears in my eyes, something very strange going back stage.

I had a lot of confidence once the amendment to the amendment was offered, because it is right to charge fees to fix the nurse education in the USA, that is why i think that something dirty is happening…

We cannot do anything against that, we will not have a better chance then that.

Why the hell they don’t stop all the CGFNS and NCLEX exams, when no visas are available?

All our money, energy and time is simply wasted. The last 50,000 visas were issued in 2005. And even till today people are registering for CGFNS, NCLEX, TOEFL etc. Why can’t they stop all of it when they do not want foreign NURSES? The California Nurses Association’s hand in these matters very clearly shows that they are not in need of any more nurses.

VERY VERY disappointing indeed!!!

ONE LOGICAL REASON FOR REMOVAL OF THE AMENDMENTS IS THAT IT WILL BE ATTACHED TO ANOTHER BILL THAT WON’T BE VETOED. IT IS CERTAIN THAT HR3043 WILL BE VETOED BY THE PREZ. ONLY HLG IS IN A POSITION TO EXPLAIN.

WHY IS IT TAKING SO LONG FOR HLG TO POST ITS MESSAGE????

Dear Schedule A friends,

Now another circus is over. Finally I am able to get over from my head, the feeling, “America, the land of immigrants, the new world for hard working people. Country where equality, love, liberty etc prevails”. I understood the land in only for illegal immigrants.

I just cannot believe what an IDIOT I am. It took 3 long years to understand and come to this conclusion. Three years of preparations, exams, interview by employer, petitioning, retrogression………….

Long 3 years of hardwork, suffering, pain………… .……………What a shear wastage of prime youth chasing the Great American dream.

Now today is a great day. Beginning of another journey. Journey to another good country which needs me. I am sure that journey will be much lighter and easier than great American Dream. I am sure that country is going to treat me with far more respect and dignity.

No more listening to promises about lifting of retrogression. No more listening to bogus words from my employer. No more caring for the employment contract. No more America.

Friends, there is no more point in keeping the American Dream. The more you wait with hope; more you become idiot of this circus. How ever hard, painful and frustrating, the message is loud and clear “America doesn’t need us”. That is a naked reality. Don’t be in a fool’s paradise.

For still optimistic weak hearted people here are some facts.

This is the 3rd failed bridge legislation for Schedule A in senate since the retrogression. If you don’t believe me, check the archives of this blog.

The target date for Senate adjournment is November 16. After that senate will rejoin only 2008 January or February. You can visit the website senate.gov and check the schedule.

Everybody knows and HLG itself have made it clear in last few posts, chances are nil for any immigration related legislation in 2008 because of presidential elections.

If the political circus is like this, I don’t find much hope for any legislation even in 2009.

Another important thing is, opposite to our belief, there is no much Schedule A shortage in US. The logic is simple, if there is any; retrogression would have been over long before. So there is no point in vending the frustrations, let the American healthcare system and patients suffer because of retrogression. The truth is there is nobody to suffer except us.

These are the facts I learned sacrificing three long years. If any one wants to contradict or continue in hope, I can only say all the best for them. But remember truth will be truth whatever you believe or hope.

Another bogus hope for physical therapists is next year’s H1B. If only 1,50,000 applicaitons came for 65,000 H1B’s this year, next year its going to be 2,50,000. All the best for great lottery.

Its high time to tear away your employment contracts and approval notices and head for another country which really needs you. It’s always better late than never. All the best for every one.

The amendment was agreed to in the Senate by unanimous concent dosn’t it means that all the Senators support it? Nobody in the House think something needs to be done with the nurses shortage?

Its all political. Hope no one interest about nation’s Health.

The politicians only care about their seats, not people’s need. Or put it another way, illegal immigrants’ need weight much more than healthcare workers’ in terms of ballot.

11/02/2007: H.R. 3043 Conference Update – Both Immigration Bills Killed!
One good news and one bad news. According to the AILA, the Conference committee took out both immigration riders from the H.R. 3043. It means that there will be no increase of the H-1B to $5,830. At the same time, there will be no recapture of EB-3 visa numbers for the Schedule A workers through this legislation.

Hi to All,

There is still hope… The reason why Sen. Schumer & Hutchinson allowed the removal of 3404 it’s because they know that the Labor-HHS will definetely will be vetoed by their STUPID Pres. who’s only concern is to bring war to the whole world.

So intead of making 3404 a casualty of war…they’ve decided to stripped it off the canvas…So that it would be easy for them to attached it to another upcoming bill which i think would be the FARM bill HR 2419…Senate will convene this nov 5…let’s just hope that the American Hospital Association & their lobbyist will make its move on that day…

Remember the 5 wise virgin who patiently awaits fro the coming of their master? That should be the Attitude my dear Schedule A friends.
