HUTCHISON RECAPTURE AMENDMENT 03/10/07

It’s been a busy week and it is being topped off with the best news that we’ve published in a very long time: Sen. Hutchison has formally introduced a provision to recapture about 90,000 visas for Schedule A nurse and PTs. This is a major piece of news.

The “Hutchison amendment” has been anticipated for a few weeks. If the Hutchison amendment passes retrogression is over.

Procedurally we have two hurdles. First, Sen. Durbin has introduced an amendment to Sen. Hutchison’s amendment; however the details of this Durbin amendment are unpublished at this time. Second, the amendment must survive review and remain attached to Senate Bill #4. S.4 is expected to pass.

Even with the hurdles this is a major step forward. We’re getting closer.

UPDATE: The language of Sen. Durbin’s amendment has been found. It contains three provisions:

1. A $1,500 “training fee”is attached to each nursing case (not PTs).
2. Healthcare workers, including MDs, who travel overseas for extended periods of time do not lose their US Permanent Residency if they are working in select (unnamed) countries.
3. Healthcare workers, including MDs, are inelgible for US Permanent Residency if they have a “financial obligation” to their home country.

I’m strongly worried for declining health service in the US and the Oversea Nurses wants to help the people in America. Retrogression must be over, to save the health system in America and better life for Nurses.

it would be unlikely that the amendment would not be attached to senate bill# 4 would it not?
Hopefully Senator Durbin’s Amendment contains just minor changes.
It would be unlikely that the amendment would be massacred in review one would think…especially as a precedent has already been established with previous recapture….what do you think HLG?

What is the scenario if it doesn’t remain attached to Senate bill #4.

It’s hard not to feel some elation with this latest news :)

Thank you for everything. My dream is coming closer to reality. I would like to ask you approximately how long will it take for the Hutchison Amendment to be passed? Are we talking weeks or months and are our chances greater than 50%…75%… Lastly, please let us know about the Durbin amendment and it’s importance to us as soon as news becomes known. I think this is what Sen Durbin says

“Senator Durbin offered Senate Amendment 442, an amendment to the Hutchison amendment. Durbin’s amendment would tack on a $1500 fee to each of the green cards covered in the Hutchison provision. It would also bar nurses, doctors and other health care workers from coming to the US if they have an “outstanding obligation” to their home country for financial support funding their education. Finally, the Durbin amendment would allow nurses and doctors who have received green cards to preserve their residency in the US if they are going to developing countries to provide health care services.

My I-140 was filed via regular processing then later shifted to premium processing in Aug 2006, approved in Oct 2006 Nebraska Center and was received at the NVC in December 2006 and given an NVC Case number.

I know someone who has a priority date of june 2006 and I-140 approved last january 2007. The document is not yet received by the NVC.

Which one will the NVC process first? My papers that was received by the NVC first. Or will it still follow the priority date?

Thank you. Hoping and praying that this retrogression be lifted the soonest time possible.

Dear HLG,
My nurse wife is already in the US working due to the 2005 visa recapture.Me and my kids stayed behind but was caught by the retrogression.We are just waiting for visa availability to be scheduled for consular interview since we are already documentarily qualified as per the local US embassy.

As derivative beneficiaries of my wife, are we included on the numbers that will benefit from this proposed visa recapture for nurses?

Am actually relieved by what is proposed in Durbin amendment,it is not challenging the spirit of Huchinson amendment…it is not unreasonable…nothing that us nurses can’t handle,we’ve trod the journey thus far…bring it on:)!!!!

Thanks for all your efforts! You give us hope for a brighter tomorrow. I am concerned about what I have been reading on other web sites, though. I’ve been reading on other immigration sites that Congress won’t let the Hutchison amendment remain attached to Senate Bill #4. S.4. I was reading that Congress won’t handle piecemeal legislation before pass/fail of CIR. I welcome your comments on this and, also, is anti-immigration sites like numbersusa a threat to us again? All I want is a speedy end to retrogression in Schudule A so I can pursue a happly life in America. With Love….

It seems that the SA275 was voted with a result of 69 yea’s and 26 nay’s…

however for S4, Cloture motion on the bill withdrawn by unanimous consent in Senate, what the heck does this mean?

is it likely that the amendment won’t pass review?Surely not??

What is the likehood and what would be the implication if the amendment were not attached to bill #4….also what is the rough time frame post a bill being passed to it’s coming to fruition? Can HLG or any nurse out there kindly list the basic steps of the procedural scenario….i am clueless re same

Dear HLG, we cannot say enough how much we appreciate your willingness to help us.

Does the amendment has a chance to pass in the senate while attached to this bill? i’ve read the senate record votes and seen that a lot of amendment are attached to this bill, and a lot of them where ruled non-germane by the chair. Is it because the purpose of the amendment is not linked to the purpose of the law, and if so, what do you think are the chances of this amendment to pass and not being “non-germane”?

What is the chances of passing the bill in the coming month and what is the oppinion of the house on this bill?

How likely the Hutchison amendement will be attached to S.4 to the final approval? Sen. Reid, the sponsor of S.4, said on March 8th. there are about 110 pending amendement to S.4, but only 8 of them are considered germane, and may be a couple more are argubaly germane.
Is that mean the Hutchison amendement only have about 10% oddes to be accepted by chair?

This is just my 2 cents worth guys ok? correct me if Im wrong but I think that financial obligation to one’s home country may mean that you were funded by your government in some way or another in college thru college loans/scholarships and the like? Im quite concerned about the downside of the hutchinson bill though…that it might not be attached to the S.4..or that it may be junked altogether..oh well..HLG thanks again..no matter how this turns out, I will be forever grateful. anyone who can explain in details about sen durbin’s amendment? what do you mean by 1500$ training fee attached to each nursing case …are we going to pay for that or our employer?
April Visa bulletin is out and it stated there that maybe in May employment visa will be unavailable…I just hope that Sen. Hutchison amendment will pass soon so that retrogression is over for us schedule A applicant. To HLG More Power ,we are so grateful for your time & efforts.

on senate website it appears that on agenda for tuesday the 13th is “resume condideration of s4″….does this mean that there is still some hope…it seems therefore that ammendment WAS not attached to bill#4…darn…mary kennedy

to one comment…can we please not grumble/quibble re any fees that the Durbin amendment may impose..it is not unreasonable that there be some kind of training fee attached to our green card…let’s just look at counting our blessings if we get our green card in the not too distant future… to quibble re fees attached to priviledge of green card only fuels the feelings of anti-imigration groups who already carry ideas such as we want to get on the USA “gravy train”….Durbin’s amendment is the least of our worries…we have all had to make big financial sacrifices to get thus far…Mary kennedy

ok guys, i am no lawyer and i don’t know much about the american immigration system, but, this is what I understood and I hope it helps answering some of the questions I have read so far. I believe that the extra 1500 dollars in sen.Durbin’s ammendment will be imposed on those I-140 petitions that have not been submitted yet.The ones that have their nvc cases approved and are just waiting for packet 4, are not affected by it, at least that’s what i understood.About the fact that the senate invoked cloture, what it means is that they are setting a time limit in deciding about the bill, which is good news.The hutchinson ammendment is part of another big ammendment s.a 275, which is the security act for 2007.They followed a very similar approach in 2005 before retrogression was lifted.
I pray this is solved quickly.Thank you HLG for all your help and god bless.

Reading the text of the Durbin ammendment it says ( as far as I can tell!)” 1500$ fee paid by EMPLOYER for each sponsored nurse” and that those wishing to have green card who are under financial obligation for their nurse/MD training would be barred from obtaining same unless there was an agreement of sorts in place between themselves and home country, these conditions to come into being 180 days after any enactment of proposals”. Please correct me if I am wrong anyone?
