While news out of Washington DC is slow right now (as is always the case at year’s end), HLG is hearing that there is already a movement afoot to push Congress to get a small recapture bill passed within the first 10 weeks or so of 2007. Over the course of the spring Congress will debate a wide-ranging CIR-type bill, which healthcare immigration advocates hope will include a complete Schedule A exemption from the Green Card quota.

A time line might look like this:

Feb-March 2007: small allotment for Schedule A workers, perhaps 10-25,000 visas. Whether dependents are included is undecided at this point, but our hunch is they will be treated as they are now — i.e. part of the quota.

Summer 2007: wide-ranging CIR is passed which includes an exemption for all Schedule A applicants.

If the recapture bill does get passed by March 07, when will they be made into effect?
I would also like to thank you people for providing up to date information and most important hope for us who are affected by the retrogression.

I’ll try and answer the first three comments in order:

1. Congress is likley to spend the first few months worried about (what they believe) are more pressing issues: minimum wage, etc. It is sometimes tough to remember that there are other issues other than immigration!

2. You can ALWAYS file I-140s. Indeed, that is how you get a priority date and get a place in line.

3. We will not know for sure until the bill is actually passed (which is not, of course, a sure thing). It is our expectation that it immediately would go into effect, more or less.

Hi,
I am RN. I filed my I140 and 485 in January 17. I140 was approved on Feb 2006. Vermont asked my additional evidance in Oct and I gave them everyhing on Oct 24rth 2006. They have everything what they need. Do you think retrogression will be in effect for my case as well?

until congress allocate additional visa numbers, your case will also remain pending(u wont be able to adjust the status of ur visa).The priority dates always matter until ur visa gets stamped.

As per what you said your approval date was Feb 2006 so that is also your priority date.Current priority date is June 15 2004 as per Jan 07 Visa Bulletin.Priority dates later than that is affected by the retrogression.

To HLG and others who may know…

I have filed I 140 at October 31 2006. Would it be reasonable to make premium I140 processing (pay 1000$ in order to approve the petition within 15 days)in order to improve my chances to get into these additional numbers??? I would very much appreciate your opinion

Your priority date for nurses and PT’s is the date you file your I-140. It is NOT the date the I-140 gets approved. In the above case the PD will be Oct 31st, 2006.

But the retrogesstion was effective from Nov 1st 2006 right? but my requirements was fulfilled in Oct 24rt 2006. Do no you think it will not affect?

All the immigrant visa nos has been used up by oct’06 from the schedule A Visa quota.(no visa available for schedule A) Unless and until addiotnal visa numbers are allocated, there wont be any more further processing.

Everyone should hope that small amount of visa will be alloted for Schedule A this coming months so that all cases will be open for possible processing..HAPPY NEW YEAR!

My priority date is 15-jun-2005, what is the possible date of getting a visa interview for me and my family.

If ur packet three is already submitted at NVC then once additonal visa numbers are alloted by congress,ur papers will be forwarded to the respective consulate to arrange the interview. It might take around 3 months once ur priority date becomes current.

hi im a nurse. i wanted to if i can still file the I-140 even if there’s this retrogression thing going on. and how much roughly it will cost me. i need some advice and a good lawyer. thanks

Thank you all for updating the latest news with out any delay. By reading all the comments and news, what I found is, it will be atleast one year to restart the process in the full flow. This is only if the congress accepted the present draft by maximum next month(February), and then the signature from the president, would probably by June / July, then to the NVC to come out of their sleep may take another 1 month or more…..Finally there is a ray of hope, things back to normal from September 2007 onwards, that is also for how many cases……Does anybody agree this openion unless any other observation?

i am indian nurse, my petition for I140 has approved on 10th august, and my recepient date is 26th july,i saw the processing dates , the current processing date is 17 july, as my date is to close so after being the visa number available how much time it will take for my embassy interview? thanking u, plz guide me on this matter
